【摘要】：謝覺(jué)哉是中共老一輩無(wú)產(chǎn)階級(jí)革命家,是新中國(guó)法學(xué)界的先導(dǎo),是人民司法制度的奠基者之一。人民調(diào)解工作產(chǎn)生于第二次國(guó)內(nèi)革命戰(zhàn)爭(zhēng)時(shí)期,謝覺(jué)哉的人民調(diào)解思想是對(duì)過(guò)去中共領(lǐng)導(dǎo)下的人民調(diào)解工作的理論上的總結(jié)和升華。同時(shí),謝覺(jué)哉的人民調(diào)解思想作為陜甘寧邊區(qū)多種因素結(jié)合的產(chǎn)物,反過(guò)來(lái)對(duì)當(dāng)時(shí)陜甘寧邊區(qū)的社會(huì)建設(shè)產(chǎn)生了深遠(yuǎn)的影響。 本文對(duì)謝覺(jué)哉的人民調(diào)解思想做了比較系統(tǒng)的研究,全文結(jié)構(gòu)分為前言、正文和結(jié)語(yǔ)三塊。其中正文共分為四部分：第一部分介紹謝覺(jué)哉人民調(diào)解思想形成的背景,包括政治背景、現(xiàn)實(shí)動(dòng)力和實(shí)踐基礎(chǔ)；第二部分闡述了謝覺(jué)哉人民調(diào)解思想的主要內(nèi)容,包括調(diào)解的原則和形式；第三部分分析了謝覺(jué)哉人民調(diào)解思想的特點(diǎn)；第四部分論述了謝覺(jué)哉人民調(diào)解思想對(duì)陜甘寧邊區(qū)社會(huì)建設(shè)的影響。 謝覺(jué)哉作為人民司法制度的奠基人,其人民調(diào)解思想是對(duì)陜甘寧邊區(qū)政府時(shí)期調(diào)解工作的高度總結(jié)。系統(tǒng)地研究謝覺(jué)哉的人民調(diào)解思想的主要內(nèi)容、特點(diǎn)和影響,有助于人們從一個(gè)側(cè)面了解陜甘寧邊區(qū)政府工作的態(tài)度和方向,對(duì)當(dāng)前我國(guó)人民調(diào)解的立法和實(shí)踐工作也可以提供一定的歷史借鑒。
[Abstract]:It is one of the founders of the new Chinese law field , which is one of the founders of the people ' s judicial system . The people ' s mediation thought is the theoretical summary and sublimation of the people ' s mediation work under the leadership of the Communist Party of China .

This paper makes a systematic study on the thought of people ' s mediation , which is divided into three parts : preface , text and conclusion . The text is divided into four parts : the first part introduces the background of the formation of the thought of the people ' s mediation , including political background , realistic motivation and practical basis ;
The second part expounds the main contents of the thought of the people ' s mediation , including the principles and forms of mediation ;
The third part analyzes the characteristics of the people ' s mediation thought .
The fourth part discusses the influence of the people ' s mediation thought on the social construction of the Shaanxi - Gansu - Ningxia Border Region .

Thank you for being the founder of the people ' s justice system , the people ' s mediation thought is the height summary of the mediation work during the government period of the Shaanxi - Gansu - Ningxia Border Region . The main contents , characteristics and influence of the people ' s mediation thought are studied systematically . It is helpful to understand the attitude and direction of the work of the government in the Shaanxi - Gansu - Ningxia Border Region from one side , and provide some historical reference for the legislation and practice of the people ' s mediation in China .
