【摘要】：近代城市土地管理制度的變革形成了不同的路徑,其中租借地城市土地管理制度的變革有的有明顯的移植和獨(dú)創(chuàng)的特征,有的則有明顯的"二元化"特征。以青島和威海為例,二者同為租借地城市,但在土地產(chǎn)權(quán)管理制度的變革中,一個(gè)移植了西方的制度,確立了較為完善的近代化的土地產(chǎn)權(quán)管理制度,一個(gè)卻更多地保留了中國(guó)傳統(tǒng)的制度。制度的不同變革模式既有德、英不同法律傳統(tǒng)的影響,又有文化的影響。
[Abstract]:The transformation of modern urban land management system has formed different paths, some of which have obvious characteristics of transplantation and originality, and some have obvious characteristics of "dualization".Taking Qingdao and Weihai as examples, both of them are lease cities, but in the reform of land property right management system, a western system has been transplanted, and a more perfect modern land property management system has been established.One, however, retains more of the traditional Chinese system.The different reform models of the system have both the influence of morality, the influence of different legal traditions in England and the influence of culture.
