【摘要】：本文以晚清上海公共租界讞員為研究對(duì)象,在簡(jiǎn)要介紹歷任讞員基本情況的基礎(chǔ)上,主要圍繞讞員的資歷與背景、任期與離職等一般特征以及讞員的司法審訊等日常工作展開(kāi)論述,并將讞員置于晚清上海復(fù)雜的政治格局之中加以審視,以期揭示位低權(quán)輕的讞員處于華洋對(duì)峙與沖突的夾縫中進(jìn)退兩難的尷尬處境。第一章“公共租界讞員的出現(xiàn)”,主要敘述晚清上海公共租界讞員的基本情況。在對(duì)會(huì)審公廨18名讞員作簡(jiǎn)單介紹,試圖展示讞員個(gè)體形象之外,圍繞資歷與背景、任期和離職等問(wèn)題,對(duì)讞員群體的一般特征作具體的量化分析。第二章“讞員的日常工作”,圍繞讞員的兩項(xiàng)主要工作,即案件審理以及發(fā)布告示,展開(kāi)論述。作為會(huì)審公廨的掌印官,讞員需要受理大量的公堂案件,包括每日的公堂瑣案以及定期的會(huì)訊案件。除了本職的司法工作外,讞員還肩負(fù)不可推卸的行政職責(zé),其中,為維護(hù)租界秩序,加強(qiáng)社會(huì)管理而頒發(fā)告示,是讞員最常見(jiàn)的行政工作。因身處租界的特殊環(huán)境,讞員在工作的過(guò)程中,難免會(huì)與租界當(dāng)局發(fā)生權(quán)力沖突。第三章“讞員的個(gè)案分析”,對(duì)首任讞員陳福勛以及三任讞員的關(guān)綱之進(jìn)行個(gè)案分析。在對(duì)讞員群體的基本情況以及工作內(nèi)容作出總體性描述后,本章以陳福勛和關(guān)綱之為代表,對(duì)他們的讞員生涯作具體詳細(xì)的介紹。通過(guò)對(duì)前后不同時(shí)期任職讞員的分別考察,有助于展現(xiàn)不同時(shí)段下讞員工作情形的變化。第四章“官、商之間——讞員的權(quán)力關(guān)系”,將讞員置于晚清上海復(fù)雜的政治格局之中,分別考察讞員與華界政治、讞員與租界當(dāng)局之間的權(quán)力關(guān)系。此外,隨著滬上紳商團(tuán)體的崛起,在華洋當(dāng)局之外,讞員的權(quán)力又遭到了來(lái)自商會(huì)的分割與限制。結(jié)語(yǔ)在前文的基礎(chǔ)上,主要對(duì)讞員的處境與地位作出評(píng)述,以期揭示身處晚清上海復(fù)雜政治格局之中,位低權(quán)輕的讞員,在中外權(quán)勢(shì)之爭(zhēng)中,勢(shì)必陷入進(jìn)退兩難的境地。
[Abstract]:Based on a brief introduction of the basic situation of the former members of the public concession in Shanghai in the late Qing Dynasty, this paper focuses on the qualifications and background of the members. The general characteristics of tenure and resignation, as well as the judicial trial of the members of the department, were discussed, and the members of the prison were placed in the complex political structure of Shanghai in the late Qing Dynasty to be examined. The first chapter, "the appearance of public concession officials", mainly narrates the basic situation of Shanghai public concession officers in the late Qing Dynasty. A brief introduction was made by 18 members of the mixed Court, This paper attempts to show the individual image of the members of the department, and makes a specific quantitative analysis of the general characteristics of the prison staff group around the issues of seniority and background, tenure and resignation. Chapter two, "the Daily work of the members of the Department", revolves around the two main tasks of the members of the department. That is, the trial of cases, the publication of notices, and the discussion. As the chief printer of the mixed Court, the members of the court have to accept a large number of court cases, including daily court cases and regular hearings. In addition to their own judicial work, Members of the department also shoulder unshirkable administrative responsibilities. Among them, the issuance of notices to maintain order in the concession and strengthen social management is the most common administrative work of the members of the department. Due to the special circumstances of the concession, the members of the department are in the process of working. Chapter 3, "case analysis of the members of the department", makes a case study of Chen Fuxun, the first member of the department, and the outline of the three members of the department.
