【摘要】:20 世紀(jì) 80 年代以來(lái),法律文化成為研究的熱點(diǎn),至今未衰。但學(xué)人僅側(cè)重于對(duì)中華五千年的整體法制文明的研究,具體到各個(gè)朝代的法律文化,則探討得很少,所以針對(duì)某一朝代法律文化的研究是有必要的。西漢作為封建法律的奠定時(shí)期,尤其值得注意。其法律的宗法倫理、嚴(yán)于治吏、法自然、德主刑輔等原則體現(xiàn)了當(dāng)時(shí)法律文化的基本精神。 其一,宗法倫理原則,是在血緣關(guān)系的基礎(chǔ)上建立起來(lái)的一項(xiàng)基本法律原則。西漢時(shí)期,統(tǒng)治者將此原則運(yùn)用到刑法之中,形成了親親得相首匿原則;以及維護(hù)尊卑貴賤秩序的家庭倫理原則。 其二,嚴(yán)于治吏原則,是法家“明主治吏不治民”思想在西漢法律中的鮮明體現(xiàn)。通過(guò)對(duì)各級(jí)官吏瀆職、失職,經(jīng)濟(jì)犯罪,結(jié)黨營(yíng)私、朋比為奸等不法行為的嚴(yán)厲懲罰,體現(xiàn)了西漢統(tǒng)治者對(duì)官吏管理的強(qiáng)度和力度。 其三,法自然原則,由董仲舒嚴(yán)密論述,經(jīng)西漢統(tǒng)治者認(rèn)可,在西漢時(shí)就顯示了它的嚴(yán)肅性。司法時(shí)令說(shuō)是其主要內(nèi)容,皇帝遇自然災(zāi)害下赦宥詔書(shū)、“災(zāi)害什四以上”立法的實(shí)施是這一制度在西漢法律上的具體體現(xiàn)。 其四,“德主刑輔”原則,是統(tǒng)治者為了長(zhǎng)治久安,實(shí)行的一種慎刑原則。這一制度通過(guò)赦宥老、幼、婦、殘的刑法原則,及“春秋決獄”的司法審判,在西漢法律中得到了很好的貫徹。 這些法律原則中蘊(yùn)含的文化精神對(duì)其以后各封建王朝在立法、司法過(guò)程中產(chǎn)生了深遠(yuǎn)的歷史影響。
[Abstract]:Since the 1980s , the legal culture has become the hot spot of the research , so far has not fallen . But the scholar only focuses on the research on the whole legal civilization of the Chinese five thousand years , and the study of the legal culture of each dynasty is very rare , so it is necessary to study the legal culture of a dynasty . First , the principle of patriarchal ethics is a basic legal principle established on the basis of the relationship of blood . In the Western Han Dynasty , the rulers applied the principle to the criminal law , formed the principle of the first hiding of relatives and relatives , and upheld the family ethics principle of respecting the noble order . Second , the principle of governing officials is a distinct reflection of the law of the Western Han Dynasty , which reflects the strength and strength of the rulers of the Western Han Dynasty to the administration of officials . The third , the principle of law and nature , by Dong Zhongshu ' s rigorous exposition , has shown its seriousness in the West Han Dynasty by the approval of the rulers of the Western Han Dynasty . The judicial time order is the main content , the emperor pardonates the imperial examination in case of natural disasters , the implementation of the legislation of " disasters more than four " is the concrete embodiment of this system in the law of Western Han Dynasty . Fourth , the principle of " moral principal and punishment " is a kind of principle of careful punishment for the rulers in order to control the long - term peace . This system has been carried out in the law of Xihan by granting amnesty to the criminal law principles of the old , young , married and disabled , as well as the judicial trial of " Spring and Autumn Award " . The cultural spirit contained in these legal principles has far - reaching historical influence on the legislation and judicial process of feudal dynasties .
