【摘要】：賠償是人們社會法律生活中的一項重要內(nèi)容,它對調(diào)整人們的日常糾紛起著重要作用。宋代是中國古代商品經(jīng)濟發(fā)展的高峰期,在商品經(jīng)濟大潮的沖擊下,人們的義利觀發(fā)生了轉(zhuǎn)變,進而導(dǎo)致人們?nèi)粘Ｉ钪械臎_突增多,賠償?shù)某霈F(xiàn)對于糾紛的解決具有重要意義。 中國古代自西周時就有了賠償,到了宋代形成一套完整的制度,具體包括賠償?shù)囊鹪�、賠償?shù)姆N類、賠償?shù)膶崿F(xiàn)以及賠償責(zé)任的免除四部分。 宋代契約制度發(fā)達,與此相聯(lián)系,基于違反契約規(guī)定而產(chǎn)生的賠償在宋代大量存在,具體可分為違約賠償和預(yù)約賠償兩大類。侵權(quán)行為是產(chǎn)生賠償?shù)挠忠恢匾?宋代基于侵權(quán)行為而產(chǎn)生的賠償主要有因侵犯財產(chǎn)權(quán)引起的賠償和因侵犯人身權(quán)引起的賠償,侵權(quán)主體既可為人,也可是馬牛羊犬等家養(yǎng)動物。對于因家養(yǎng)動物侵權(quán)所產(chǎn)生的賠償責(zé)任由其飼養(yǎng)者來承擔(dān)。 賠償需要一定的途徑和方式來實現(xiàn),宋代賠償?shù)膶崿F(xiàn)途徑主要有司法訴訟程序、民間私了解決糾紛、干系人代償三種;實現(xiàn)方式具體包括“備而不坐”、“坐而不備”、“又坐又備”三種。與中國古代以刑為主的大背景相聯(lián)系,宋代的賠償中加入了刑罰懲罰和行政處罰,使其具有了賠償責(zé)任刑罰化、行政化的特點。賠償?shù)膶崿F(xiàn)途徑和實現(xiàn)方式緊密結(jié)合,最大限度的彌補了被侵權(quán)人所受損失。 賠償責(zé)任的免除,即對責(zé)任人賠償責(zé)任的免除,它是賠償制度的重要組成部分。宋代賠償責(zé)任的免除具體有三種情況,一是因法律上的具體規(guī)定而出現(xiàn),二是當(dāng)事人自動放棄賠償要求而出現(xiàn),三是因蠲免而導(dǎo)致賠償責(zé)任的免除。
[Abstract]:Compensation is an important content of law of human society life, to adjust people's daily disputes, it plays an important role. The Song Dynasty is the development of ancient commodity economy Chinese peak, in the tide of commodity economy under the impact of people's values have changed, which led to the conflict of people in daily life increase, compensation there is an important significance to resolve the dispute.
In ancient China, there was compensation in the West Zhou Dynasty. A complete system was formed in the Song Dynasty, including four parts, the cause of compensation, the type of compensation, the realization of compensation and the exemption of liability.
The contract system developed in Song Dynasty, in relation to this, a lot of arising from breach of contract based on the provisions of compensation exist in the Song Dynasty can be divided into specific compensation for breach of contract and compensation for the appointment of two categories. The infringement is another important reason for the Song Dynasty, which based on tort damages are mainly caused by violations of property rights damages caused by infringement of personal rights and the subject of tort compensation, both for the people, but also horses and sheep dogs and other domestic animal.
