【摘要】：法律是維護(hù)國(guó)家穩(wěn)定、各項(xiàng)事業(yè)蓬勃發(fā)展的最強(qiáng)有力的武器,也是捍衛(wèi)人民群眾權(quán)利和利益的工具。法律文本的翻譯也不斷體現(xiàn)出其嚴(yán)重性和緊要性。兩國(guó)間法律體系的交流必會(huì)借助于翻譯這一必不可少的重要手段,除此之外,法律翻譯還會(huì)影響兩國(guó)交往過(guò)程中的政治經(jīng)濟(jì)等方面目標(biāo)的有效實(shí)施。2013年9月,“絲綢之路經(jīng)濟(jì)帶”這一偉大理念由中國(guó)國(guó)家主席習(xí)近平在哈薩克斯坦納扎爾巴耶夫大學(xué)演講時(shí)提出。2016年,哈薩克斯坦首都——年輕的城市阿斯塔納,受益于中國(guó)的“一帶一路”這一偉大理念正快速發(fā)展。如今的中哈合作更是朝向多元發(fā)展,中哈關(guān)系交往更為密切,中哈法律文化的交流也呈現(xiàn)出蓬勃發(fā)展的局勢(shì)。2015年6月10日,哈薩克斯坦勞動(dòng)和社會(huì)發(fā)展部部長(zhǎng)塔瑪拉·杜依謝諾娃在第二十四屆國(guó)家職業(yè)聯(lián)合代表大會(huì)上表示,在2015年8月15日之前制定新的《勞動(dòng)法》。本文以新《哈薩克斯坦共和國(guó)勞動(dòng)法》的翻譯為例,闡述了法律文本特點(diǎn)、翻譯中應(yīng)遵循的原則、本次翻譯過(guò)程中所使用翻譯方法和翻譯技巧以及翻譯過(guò)程中遇到的難點(diǎn),旨在總結(jié)法律文本的翻譯方法、技巧以及此類(lèi)方法與技巧在解法律文本翻譯過(guò)程中的運(yùn)用。
[Abstract]:Law is not only the most powerful weapon to maintain national stability and flourish, but also the tool to safeguard the rights and interests of the people. The translation of legal texts also reflects its seriousness and urgency. The exchange of legal systems between the two countries is bound to benefit from the essential and important means of translation. In addition, legal translation will also affect the effective implementation of the political and economic objectives of the two countries in the course of their exchanges. In September 2013, The great idea of the Silk Road Economic Belt was put forward by Chinese President Xi Jinping in a speech at Nazarbayev University in Kazakhstan. In 2016, the capital of Kazakhstan, the young city of Astana, The great idea of Belt and Road, which has benefited from China, is developing rapidly. Today, the cooperation between China and Kazakhstan is more diversified, the Sino-Kazakh relations are closer, and the legal and cultural exchanges between China and Kazakhstan are also showing a situation of vigorous development. On June 10, 2015, Kazakhstan's Minister of Labour and Social Development, Tamara Duisenova, told the 24 National Congress of Professional unions that a new Labour Code would be enacted by August 15, 2015. Taking the translation of the new Labor Law of the Republic of Kazakhstan as an example, this paper expounds the characteristics of the legal texts, the principles to be followed in translation, the translation methods and techniques used in this translation process and the difficulties encountered in the process of translation. The purpose of this paper is to summarize the translation methods and techniques of legal texts and the application of such methods and techniques in the translation of legal texts.
