【摘要】：當(dāng)代中國的村規(guī)民約是規(guī)范村民行為、維護(hù)村莊秩序的一種社會規(guī)范。在西北民族地區(qū),具有多元文化背景的村規(guī)民約是當(dāng)?shù)卮迕駥嵭谢鶎幼灾蔚闹匾?guī)范依據(jù)。甘肅省臨夏縣達(dá)沙村的村規(guī)民約基于村民之間的互相理解與尊重,維護(hù)了村內(nèi)的民族團(tuán)結(jié);通過融合法、理、情,維護(hù)了村內(nèi)的公共秩序。但與此同時,達(dá)沙村的村規(guī)民約也存在著文本形式簡單、內(nèi)容空泛,權(quán)利義務(wù)設(shè)定不平衡等問題。因此,在當(dāng)前國家提出"一帶一路"戰(zhàn)略及依法進(jìn)行社會治理的背景下,應(yīng)當(dāng)認(rèn)真對待西北民族地區(qū)村規(guī)民約的文本制定以規(guī)范其形式;吸收實踐中發(fā)揮積極作用的其他社會規(guī)范以充實其內(nèi)容;改變重義務(wù)、輕權(quán)利的規(guī)則配置模式以加強(qiáng)其權(quán)利設(shè)定。
[Abstract]:The village rule in contemporary China is a social norm for regulating villagers' behavior and maintaining village order. The rules and regulations of villages with multicultural background are the important normative basis for the local villagers to carry out grass-roots autonomy. The regulations of Dasha Village in Linxia County of Gansu Province are based on mutual understanding and respect among the villagers and maintain the unity of nationalities in the villages. Through the method of fusion, reason and emotion, the public order in the village has been maintained. But at the same time, the village rules and regulations of Dasha Village also have some problems such as simple text form, empty content, imbalance of rights and obligations, etc. Therefore, Under the background of "Belt and Road" strategy put forward by our country and social governance according to law, we should seriously take the text of village rules and regulations in northwest ethnic areas to regulate its form. It absorbs other social norms which play an active role in practice to enrich its content, and changes the rule allocation model of emphasizing obligations and neglecting rights to strengthen its right setting.
