【摘要】：不同于"法治文化"和"法律文化","文化法制"是一個(gè)極具中國(guó)特質(zhì)的概念,是"法治中國(guó)"理念在建設(shè)有中國(guó)特色社會(huì)主義文化領(lǐng)域的重要體現(xiàn)。作為中國(guó)文化治理的特定方式,黨和國(guó)家"文化法制"思維的形成經(jīng)歷了從"政策宣揚(yáng)"到"依法規(guī)制"的探索過(guò)程。在我國(guó)特定的歷史語(yǔ)境、時(shí)代背景、法律制度和治理需要下,中國(guó)文化領(lǐng)域的規(guī)范體系設(shè)計(jì)承載著除法律本體作用外更為復(fù)雜、多元的社會(huì)功能。通過(guò)對(duì)"文化法制"概念的歷史性剖析和系統(tǒng)性回應(yīng),可以打通、串聯(lián)對(duì)文化生成具有影響作用的諸如意識(shí)形態(tài)、歷史傳承影響等各要素之間的關(guān)系,構(gòu)筑法律規(guī)范與文化塑造之間的橋梁,確保文化領(lǐng)域立法在內(nèi)在邏輯、適用性和操作性等方面的協(xié)調(diào)、統(tǒng)一,引導(dǎo)、規(guī)范當(dāng)代國(guó)人心靈秩序和倫理組織生活,進(jìn)而創(chuàng)建有益于民族、國(guó)家、公民三維一體的社會(huì)生活。
[Abstract]:Different from "culture of rule of law" and "culture of law", "cultural legal system" is a concept with Chinese characteristics and an important embodiment of the idea of "ruling by law" in the field of building socialist culture with Chinese characteristics. As a special way of Chinese cultural governance, the formation of the thinking of "cultural legal system" of the Party and the state has experienced a process of exploration from "policy propaganda" to "regulation by law". In the specific historical context, the background of the times, the legal system and the need of governance in China, the design of the normative system in the field of Chinese culture carries a more complex and pluralistic social function in addition to the role of the legal Noumenon. Through the historical analysis and systematic response to the concept of "cultural legal system", the relationship between various factors, such as ideology, historical heritage and so on, which has an impact on the formation of culture can be connected in series. To build a bridge between legal norms and cultural shaping, to ensure the coordination, unity and guidance of legislation in the field of culture in terms of internal logic, applicability and operability, and to standardize the spiritual order and ethical organization life of contemporary Chinese. And then create a three-dimensional social life beneficial to the nation, country and citizen.
