【摘要】：村民自治是我國基層民主的重要組成部分和重要體現(xiàn),村規(guī)民約是村民實行自治的重要依據(jù)。我國貴州省黔東南地區(qū)是苗族、侗族的聚集區(qū),該地區(qū)治理法文化內(nèi)容豐富,尤其是以村規(guī)民約為主要形式的習慣法對苗族、侗族社會的生產(chǎn)生活產(chǎn)生極大的影響。黔東南地區(qū)很多少數(shù)民族村寨一直保留有鼓樓議事、寨老議款、民間契約、苗族議榔等有特色的蘊含有傳統(tǒng)文化的習慣法,鄉(xiāng)村道德、風俗習慣、民風民俗,無不體現(xiàn)在村規(guī)民約之中,并且這些村規(guī)民約長期對民族地區(qū)人民的日常生產(chǎn)生活、行為規(guī)范、風俗教化起到了潛移默化作用。本文以黔東南地區(qū)的苗族、侗族等少數(shù)民族為研究對象,對村規(guī)民約產(chǎn)生的原因、村規(guī)民約所包含的內(nèi)容、少數(shù)民族地區(qū)村規(guī)民約的特點以及現(xiàn)代村規(guī)民約對少數(shù)民族傳統(tǒng)文化繼承中產(chǎn)生的作用及問題,最后通過問題的呈現(xiàn)并提出如何解決村規(guī)民約對傳承少數(shù)民族地區(qū)傳統(tǒng)文化完善措施的方法。
[Abstract]:Villager autonomy is an important part and embodiment of grass-roots democracy in our country. Qiandongnan area of Guizhou Province is a gathering area of Miao and Dong ethnic groups. This area has rich cultural contents of governance law, especially the customary law, which takes the village rules and regulations as the main form, has a great impact on the production and life of Miao and Dong communities. Many minority villages in the southeast of Guizhou have always retained the customary laws, rural morality, customs and customs, which contain traditional culture, such as the drum tower, the village old proposal, the folk contract, the Miao nationality, and so on. All of them are embodied in the rules of the village, and these conventions have played an imperceptible role in the daily production, behavior and custom of the people in the minority areas for a long time. In this paper, the Miao, Dong and other minority nationalities in the southeast of Guizhou are taken as the research objects, and the causes of the village rules and the contents of the village rules and regulations are discussed. The characteristics of village rules and regulations in minority areas and the role and problems of modern village rules in inheriting the traditional culture of ethnic minorities, Finally, through the presentation of the problem and how to solve the village rules and regulations on the transmission of traditional culture in ethnic minority areas to improve the measures.
