“異姓為嗣”問題中的禮、法、俗——以明清浙南族規(guī)修訂為例

【摘要】:浙南地區(qū)收養(yǎng)異姓子,并以異姓子主祭的現(xiàn)象,被南宋理學(xué)家關(guān)注。隨著明清宗族組織的發(fā)展和族產(chǎn)的擴大,鄉(xiāng)間抱養(yǎng)異姓、異姓為嗣,從放任不受管制的狀態(tài),變成宗族管理、限制的重點事項,并在族譜編纂中發(fā)展出一套針對立嗣異姓的規(guī)則和安排異姓子孫的方法。在這個過程中,"民不祀非族"的理念和"異姓不得亂宗"的律條,被各方所引用和詮釋;訴訟成為人們修改規(guī)則的手段。禮、法關(guān)系的歷史,賦役制度變革帶來國家與家庭關(guān)系的改變,宗族組織的發(fā)展趨勢,以及每個宗族內(nèi)部的資源分配和權(quán)力斗爭,都給"異姓為嗣"習(xí)俗的產(chǎn)生、確認(rèn)和改變帶來影響。
[Abstract]:The phenomenon of adopting children with different surnames and taking different surnames as their principal sacrifice was concerned by the Neo-Confucianism of the Southern Song Dynasty. With the development of clan organizations in the Ming and Qing dynasties and the expansion of the clan property, the countryside adopted different surnames, different surnames as heirs, and from the state of laissez-faire, it was not regulated. To become the focus of clan management and restriction, and to develop in the compilation of genealogy a set of rules for establishing different surnames and methods for arranging descendants of different surnames. In this process, the idea of "people do not sacrifice to non-ethnic groups" and the law that "different surnames must not be disorderly" were developed. Cited and interpreted by all parties; Litigation has become a means for people to amend the rules. The history of propriety and legal relations, the reform of the system of servitude has brought about changes in the relations between the state and the family, and the trend of the development of clan organizations. The distribution of resources and the struggle for power within each clan have had an impact on the creation, recognition and change of the practice of "different names as heirs".
