【摘要】：近年來(lái)越來(lái)越多的中國(guó)公民走出國(guó)門，與外界接觸不斷增多的同時(shí)，中國(guó)公民面臨的海外安全形勢(shì)也越來(lái)越嚴(yán)峻。中國(guó)公民海外安全事件頻繁發(fā)生，，使得如何有效保護(hù)中國(guó)公民的海外安全，成為了“外交為民”的中國(guó)外交部門目前亟需解決的問題，也是“以人為本”的我國(guó)政府的努力方向。在眾多保護(hù)公民海外安全的途徑中，最基本、最重要、最核心有效的方式就是領(lǐng)事保護(hù)。而由于中國(guó)的領(lǐng)事工作起步較晚，近年來(lái)雖取得重要進(jìn)展，但還存在一些不足之處需要完善。因此，對(duì)我國(guó)領(lǐng)事保護(hù)的研究具有重要的現(xiàn)實(shí)意義。 本文在搜集大量文獻(xiàn)的基礎(chǔ)上，較多采用文獻(xiàn)分析法和比較分析法對(duì)領(lǐng)事保護(hù)進(jìn)行研究，文章主要內(nèi)容包括：對(duì)領(lǐng)事保護(hù)的內(nèi)涵、理論基礎(chǔ)等一些基本問題的闡述；對(duì)中國(guó)公民海外安全事件和安全事件頻發(fā)原因進(jìn)行分析；對(duì)我國(guó)領(lǐng)事保護(hù)現(xiàn)狀的基本介紹；發(fā)達(dá)國(guó)家的領(lǐng)事保護(hù)特點(diǎn)，其先進(jìn)經(jīng)驗(yàn)對(duì)我國(guó)領(lǐng)事保護(hù)的啟示和借鑒；在文章最后中提出了我國(guó)領(lǐng)事保護(hù)的完善途徑和一些具體措施。這些措施從領(lǐng)事保護(hù)制度、領(lǐng)事保護(hù)實(shí)施機(jī)制和領(lǐng)事保護(hù)工作三個(gè)方面論述，包括加快我國(guó)領(lǐng)事保護(hù)的立法進(jìn)程、加強(qiáng)與其他國(guó)家的雙邊合作、完善我國(guó)領(lǐng)事保護(hù)的各項(xiàng)實(shí)施機(jī)制、加大對(duì)領(lǐng)事保護(hù)人力資源投入、加強(qiáng)宣傳力度、掌握信息量等等內(nèi)容。 本論文側(cè)重點(diǎn)在于對(duì)包括美國(guó)、日本、歐盟為代表的發(fā)達(dá)國(guó)家和領(lǐng)事保護(hù)特點(diǎn)做了歸納闡述，其中美國(guó)的預(yù)警機(jī)制、歐盟的集體保護(hù)、日本的官民結(jié)合機(jī)構(gòu)保護(hù)都對(duì)中國(guó)領(lǐng)事保護(hù)的探索有借鑒意義。文章最后針對(duì)我國(guó)目前領(lǐng)事保護(hù)存在的問題，進(jìn)行分析總結(jié)，提出具體完善措施和建議，以期能對(duì)我國(guó)領(lǐng)事保護(hù)工作的完善盡微薄之力。
[Abstract]:In recent years, as more and more Chinese citizens go abroad and keep in touch with the outside world, the overseas security situation faced by Chinese citizens is becoming more and more serious. The frequent overseas security incidents of Chinese citizens make how to effectively protect the overseas security of Chinese citizens become a problem urgently needed to be solved by the Chinese diplomatic department, which calls "diplomacy for the people." It is also the direction of our government's efforts. Among the many ways to protect citizens' overseas security, consular protection is the most basic, most important and most effective way. Due to the late start of consular work in China, important progress has been made in recent years, but there are still some deficiencies to be improved. Therefore, the study of consular protection in China has important practical significance. On the basis of collecting a large number of documents, this paper mainly uses the literature analysis method and the comparative analysis method to study the consular protection. The main contents of the article include: the connotation of consular protection, the theoretical basis and other basic issues; This paper analyzes the causes of overseas security incidents and security incidents of Chinese citizens, introduces the status quo of consular protection in China, the characteristics of consular protection in developed countries, and the enlightenment and reference of its advanced experience to consular protection in China. At the end of the article, the author puts forward the perfect ways and some concrete measures of consular protection in our country. These measures are discussed in three aspects: the system of consular protection, the implementation mechanism of consular protection and the work of consular protection, including speeding up the legislative process of our country's consular protection and strengthening bilateral cooperation with other countries. Improve the implementation mechanism of consular protection in China, increase the human resources investment in consular protection, strengthen propaganda, grasp the content of information, and so on. This thesis focuses on the characteristics of developed countries and consular protection, including the United States, Japan and the European Union. Among them, the early warning mechanism of the United States, the collective protection of the European Union, The protection of the government-people-combination institutions in Japan is of great significance to the exploration of Chinese consular protection. Finally, aiming at the problems existing in the consular protection of our country, this paper analyzes and summarizes the problems, and puts forward some concrete measures and suggestions to improve the consular protection work in our country in the hope of contributing to the perfection of the consular protection work in our country.
