歐盟的非正式治理模式芻議——以歐盟難民政策的發(fā)展為例

【摘要】:不同于對歐盟的主流認識。歐盟各個政策領域中背離正式規(guī)則的政治實踐無處不在。就歐盟非正式治理的發(fā)生機制而言。特定政治風險與正式規(guī)則的組合會形成非正式治理的變革窗口,而特定的認知框架則會促進或限制非正式治理的發(fā)生。本文主要提出中心化和去中心化兩種類別的非正式治理,然后將現有文獻中眾多的非正式治理模式按照不同的非正式治理類別和政策階段做出完整的類型劃分。最后。本文認為在歐盟難民政策實現共同體化以后,只有部分國家面臨難民風險,加上難民問題的安全化認知導致難民政策一直由去中心化的非正式治理主導;但是近期由于難民問題發(fā)展成為席卷整個歐洲的危機以及歐洲民眾對難民問題認知框架的改變,難民政策的非正式治理受到了限制。因此,對難民政策的考量還將放到非正式治理和正式規(guī)則之間的互動中以及一體化發(fā)展程度等宏觀背景下進行深入研究。
[Abstract]:Different from the mainstream view of the EU. Political practice that deviates from formal rules in all areas of EU policy is ubiquitous. As far as the mechanism of informal governance in the EU is concerned. The combination of specific political risks and formal rules will form a window of change in informal governance, while a specific cognitive framework will promote or limit the occurrence of informal governance. This paper mainly proposes two types of informal governance: centralization and decentralization, and then classifies the various informal governance models according to different informal governance categories and policy stages. Last This paper argues that only some countries face the risk of refugees after the EU refugee policy realizes communization, and the cognition of refugee problem security results in that the refugee policy has been dominated by the decentralization of informal governance. But the informal governance of refugee policy has been constrained by the recent crisis that has engulfed Europe as a whole and the change in the framework of European people's perception of refugee issues. Therefore, the consideration of refugee policy will be further studied in the context of the interaction between informal governance and formal rules and the degree of integration.
