東盟及其成員國(guó)關(guān)于《南海行為準(zhǔn)則》之議案評(píng)析

【摘要】:東盟及其若干成員國(guó)是《南海行為準(zhǔn)則》的主要推手,為此,東盟提出了六項(xiàng)"核心要素",印度尼西亞則提出了"零號(hào)草案"。從《南海各方行為宣言》到《南海行為準(zhǔn)則》是大勢(shì)所趨,中國(guó)應(yīng)積極地參與這一過(guò)程并為此做好準(zhǔn)備。對(duì)于東盟的"核心要素",中方需要以國(guó)家利益為基準(zhǔn),依據(jù)國(guó)際法做出有針對(duì)性的具體分析,并分別采取接受、有條件接受、反對(duì)的應(yīng)對(duì)措施。對(duì)于印尼"零號(hào)草案"中的規(guī)則導(dǎo)向、爭(zhēng)端解決機(jī)制和審議機(jī)制等提議,中方可以考慮接受,但必須強(qiáng)調(diào)保障中方的表決權(quán)。在締約方式的問(wèn)題上,與每個(gè)當(dāng)事國(guó)均進(jìn)行雙邊談判并"各個(gè)擊破"的進(jìn)路目前可能性較小,而東盟成員國(guó)"抱團(tuán)"成一邊與中國(guó)談判的傾向非常明顯,中方雖然可以力爭(zhēng)采取分別談判的雙邊進(jìn)路或者多邊進(jìn)路,但在一定條件下也可以考慮接受東盟的主張。在締約方范圍的問(wèn)題上,中方應(yīng)當(dāng)堅(jiān)決反對(duì)東盟拉其他國(guó)家干涉南海爭(zhēng)端的傾向,明確《南海行為準(zhǔn)則》是非開(kāi)放性的區(qū)域性條約,締約范圍僅包括東盟成員國(guó)和中國(guó)。
[Abstract]:ASEAN and its member states are the main promoters of the Code of Conduct in the South China Sea. For this reason, ASEAN has proposed six "core elements" and Indonesia has put forward the "Zero draft". From the Manifesto of the parties in the South China Sea to the Code of Conduct in the South China Sea is the general trend. China should take an active part in this process and make preparations for it. With regard to the "core elements" of ASEAN, China should take the national interests as the basis, make specific and targeted analysis in accordance with international law, and take countermeasures of acceptance, conditional acceptance and opposition respectively. The Chinese side may consider accepting the rules guidance, dispute settlement mechanism and deliberative mechanism in Indonesia's "zero draft", but it must emphasize on safeguarding China's right to vote. On the issue of contracting parties, the possibility of holding bilateral negotiations with each of the parties and "breaking down" is less likely at present, and the tendency of ASEAN member countries to "join forces" in negotiating with China is very clear. Although China can strive to adopt a bilateral or multilateral approach to separate negotiations, it can also consider accepting ASEAN's proposal under certain conditions. On the issue of contracting parties, China should resolutely oppose the tendency of ASEAN to pull other countries into disputes in the South China Sea, and make it clear that the Code of Conduct in the South China Sea is a non-open regional treaty, and only ASEAN member countries and China are included in the scope of the treaty.
