【摘要】：申根合作是歐洲一體化建設(shè)的重要成果,也是差異性發(fā)展最為顯著的領(lǐng)域。本文以申根法則的豁免條款——臨時(shí)恢復(fù)內(nèi)部邊境管制條款為例,分析了該差異性條款的內(nèi)容和實(shí)施情況,探討了歐盟修訂相關(guān)條款的動(dòng)因、過(guò)程和結(jié)果,并指出歐盟機(jī)構(gòu)與成員國(guó)圍繞修訂條款產(chǎn)生的分歧實(shí)質(zhì)上是超國(guó)家主義和政府間主義之爭(zhēng)。修訂后的條款存在的問(wèn)題和成員國(guó)差異性的利益訴求仍將導(dǎo)致該特殊例外的濫用難以避免,將可能強(qiáng)化申根合作的差異性發(fā)展趨勢(shì)。
[Abstract]:Schengen cooperation is an important achievement of European integration construction, and is also the most significant area of differential development. This paper takes the exemption clause of Schengen rule-temporary restoration of internal border control clause as an example, analyzes the content and implementation of the difference clause, and probes into the motivation, process and result of the revision of the relevant articles by the European Union. It also points out that the differences between EU institutions and member states over the revised terms are essentially the disputes between supranationalism and intergovernmentalism. The problems existing in the revised clause and the different interests of the member states will still lead to the abuse of the special exception, which may strengthen the development trend of Schengen cooperation.
