【摘要】：無論國際組織章程條約是否規(guī)定退出機制,成員國的單邊退出行為都會引發(fā)不同程度的關(guān)切。由《里斯本條約》引進的《歐盟條約》第50條結(jié)束了歐盟內(nèi)部有關(guān)退出機制的長期爭論,為英國"退歐"提供了相對明確的法律依據(jù)。因缺乏可資借鑒的先例,英國"退歐"所帶來的法律上的不確定性在短期內(nèi)無法消除。隨著"退歐協(xié)定"談判工作的展開,英國與歐盟早期在談判路線方面的分歧日漸式微。但從談判立場和締約機制的角度來看,雙方欲在預(yù)設(shè)期限內(nèi)完成"退歐協(xié)定"的談判和締結(jié)工作,仍面臨著潛在的法律障礙。對于包括中國在內(nèi)的第三國而言,英國"退歐"在近期并不會對歐盟與第三國的條約關(guān)系造成重大沖擊,只是在必要的情況下應(yīng)考慮未來與英國重新締結(jié)條約,以避免英國"退歐"后產(chǎn)生的法律真空。
[Abstract]:Regardless of whether the treaty of constitution of an international organization provides for a withdrawal mechanism, the unilateral withdrawal of a member State will cause varying degrees of concern. Article 50 of the EU Treaty, introduced by the Lisbon Treaty, has put an end to the long-standing debate on the exit mechanism within the EU and provided a relatively clear legal basis for Britain's "Brexit". In the absence of precedents, the legal uncertainty of Brexit cannot be eliminated in the short term. With the start of negotiations on the Brexit Agreement, the early differences between Britain and the European Union over the course of the talks have dwindled. However, from the point of view of negotiation position and treaty mechanism, the parties still face potential legal obstacles in order to complete the negotiation and conclusion of the Brexit Agreement within the preset period. For third countries, including China, Brexit from the EU will not have a major impact on treaty relations between the EU and third countries in the near future, but if necessary, it should consider reconcluding a treaty with Britain in the future. To avoid a legal vacuum after Brexit.
