【摘要】：經過50余年的發(fā)展與演變,1959年的《南極條約》目前已經發(fā)展成為以《南極條約》為核心,涵蓋1964年《南極動植物養(yǎng)護協議措施》、1972年《南極海豹公約》、1982年《南極海洋生物資源養(yǎng)護公約》、1991年《環(huán)境保護南極條約議定書》以及大量南極條約協商國會議通過的措施、建議或決議在內的南極條約體系。上世紀80年代,通過不斷的體制變革,南極機制成功克服了由"聯合國化"與"人類共同繼承遺產"動議引發(fā)的合法性危機。1991年《馬德里議定書》及其附件的簽署使得南極條約體系進入了相對穩(wěn)定的發(fā)展時期,但南極機制仍然面臨著南極海域主權要求、南極法律執(zhí)行困難以及人類活動多樣化引發(fā)的商業(yè)與資源挑戰(zhàn)。面向未來,南極條約協商國有責任采取更加積極和建設性的應對措施,以確保南極國際治理機制持續(xù)穩(wěn)定的向前發(fā)展。
[Abstract]:After more than 50 years of development and evolution, the 1959 Antarctic Treaty has now evolved to take the Antarctic Treaty as its core. Covering measures adopted by the 1964 Agreement on the Conservation of Antarctic Fauna and Flora, the 1972 Antarctic Seal Convention, the 1982 Convention on the Conservation of Antarctic Marine living Resources, the 1991 Protocol to the Antarctic Treaty on the Protection of the Antarctic Treaty, and a large number of Antarctic Treaty Consultative parties, Antarctic treaty system, including recommendations or resolutions In the 1980s, through constant institutional change, The Antarctic Mechanism successfully overcome the crisis of legitimacy arising from the "United Nations" and the "Common Heritage of mankind" initiative. The signing of the 1991 Madrid Protocol and its annexes brought the Antarctic Treaty system into a period of relatively stable development, However, the Antarctic mechanism still faces the claims of sovereignty over the Antarctic sea areas, the difficulties in the implementation of Antarctic laws and the commercial and resource challenges caused by the diversification of human activities. Facing the future, it is the responsibility of the Antarctic Treaty Consultative Party to take more active and constructive measures to ensure the sustained and steady development of the Antarctic international governance mechanism.
