【摘要】：海外利益是國(guó)家于主權(quán)管轄范圍之外在物質(zhì)與精神層面上需求的一切權(quán)益和好處。全球化時(shí)代,海外利益有其合約性、包容性等特性,各國(guó)海外利益在國(guó)境之內(nèi)、地區(qū)之間乃至全球?qū)用鏉u呈卯榫相合之勢(shì)。改革開放以來(lái),中國(guó)海外利益在快速發(fā)展的同時(shí),面臨著日益增多的現(xiàn)實(shí)威脅和潛在風(fēng)險(xiǎn),其敏感性與脆弱性日趨凸顯。國(guó)際制度乃海外利益維護(hù)的合法框架與戰(zhàn)略平臺(tái),對(duì)海外利益具有工具性作用、規(guī)范性功能和建構(gòu)性價(jià)值等功能,而上述功能的發(fā)揮則取決于國(guó)際制度成員的國(guó)際制度能力。中國(guó)海外利益的發(fā)展歷程表明,海外利益的實(shí)現(xiàn)狀況與其國(guó)際制度能力密切相關(guān),國(guó)際制度能力欠缺、國(guó)際制度路徑狹窄乃妨礙海外利益維護(hù)的痼疾。在制度化、規(guī)范化的國(guó)際社會(huì)中,中國(guó)海外利益的發(fā)展與維護(hù),不可囿于具體的物質(zhì)利益范疇,應(yīng)超越純粹的物質(zhì)利益觀和褊狹的權(quán)力思維,加強(qiáng)國(guó)際制度層面的戰(zhàn)略規(guī)劃,在參與、改革、構(gòu)建國(guó)際制度等環(huán)節(jié)上積極有為,逐漸提升國(guó)際制度能力而拓展國(guó)際制度路徑,以獲取長(zhǎng)遠(yuǎn)的戰(zhàn)略利益。
[Abstract]:Overseas interests are all rights and benefits demanded by the state on material and spiritual level beyond sovereign jurisdiction. In the era of globalization, overseas interests have the characteristics of contract, inclusiveness and so on. Since the reform and opening to the outside world, China's overseas interests have been developing rapidly, and at the same time, they are facing increasing realistic threats and potential risks, and their sensitivities and vulnerabilities are becoming increasingly prominent. The international system is the legal framework and strategic platform for the maintenance of overseas interests. It has the functions of instrumentality, normative function and constructive value to the overseas interests, and the exertion of the above functions depends on the international institutional capacity of the members of the international system. The development of China's overseas interests shows that the realization of overseas interests is closely related to its international institutional capacity, and the lack of international institutional capacity, the narrow path of international institutions is a chronic disease that hinders the maintenance of overseas interests. In the institutionalized and standardized international society, the development and maintenance of China's overseas interests should not be confined to the specific material interests, but should go beyond the pure view of material interests and narrow thinking of power, and strengthen the strategic planning of the international system. In participation, reform, construction of international system and other aspects of active and promising, gradually improve the capacity of international institutions and expand the path of international institutions, in order to obtain long-term strategic benefits.
