【摘要】：構(gòu)建人類命運(yùn)共同體,正在成為全球人權(quán)和法治事業(yè)的共同話語和價值目標(biāo),法理學(xué)研究者有必要對之加以全面深入的闡釋。在這一全新戰(zhàn)略目標(biāo)的指引下,新一代人權(quán)觀的科學(xué)內(nèi)涵可初步概括為:以人的全面發(fā)展為人權(quán)核心理念,以共同體為人權(quán)主要載體,以共商、共建、共享為人權(quán)建設(shè)的基本原則。作為全球治理戰(zhàn)略的人類命運(yùn)共同體蘊(yùn)含豐富的法文化資源,其法治構(gòu)建的要津在于通過法律和司法改革,全面落實(shí)發(fā)展權(quán)的制度化。
[Abstract]:The construction of human destiny community is becoming the common discourse and value goal of the cause of global human rights and rule of law. It is necessary for the researchers of jurisprudence to explain it thoroughly and thoroughly. Under the guidance of this new strategic goal, the scientific connotation of the new generation of human rights can be preliminarily summarized as follows: taking the all-round development of human beings as the core concept of human rights, taking the community as the main carrier of human rights, discussing and building together. Sharing the basic principles for the construction of human rights. As the strategy of global governance, the community of human destiny contains abundant legal and cultural resources, and its rule of law should be constructed by the institutionalization of the right to development in an all-round way through the reform of law and justice.
