【摘要】：因?yàn)槟茉吹臐u趨緊張,開發(fā)和利用核能己成為當(dāng)今社會(huì)經(jīng)濟(jì)發(fā)展的一個(gè)重要方面�？v觀核能的發(fā)展歷史,核安全問題向來是民眾最為關(guān)注的問題。在二十一世紀(jì),隨著中國經(jīng)濟(jì)發(fā)展加速,能源耗費(fèi)巨大,為滿足經(jīng)濟(jì)和社會(huì)發(fā)展對能源日益增長的需求,以及緩解對國外能源依賴度過高的局面,中國制定了大力發(fā)展核能的政策,從而也引起全國人民對于核安全問題的密切關(guān)注。確保核能利用的安全是一項(xiàng)系統(tǒng)性的工作,它要求我們廣泛采取法律、教育、科技等手段。政策作為調(diào)整人和人之間相互關(guān)系的一種社會(huì)規(guī)范,具有特殊的作用。深入加強(qiáng)對國際與國外的核安全政策的研究,對于保障我國核能安全以及完善我國環(huán)境保護(hù)法律體系,具有非常重要的理論和實(shí)踐意義。 文章理論聯(lián)系實(shí)際,在全面歸納與總結(jié)核安全領(lǐng)域國際法和國內(nèi)法的基礎(chǔ)上,概述了核安全國際法律制度及我國核安全立法的特點(diǎn),并指出不足之處與完善途徑。核能指的是原子結(jié)構(gòu)發(fā)生變化時(shí)所釋放的能量,核能的開發(fā)和利用包括軍用與民用,其安全問題主要表現(xiàn)在于核能利用過程中的核輻射及核廢料對環(huán)境的危害影響。國際核能安全立法包括管理放射性廢物的國際公約、核事故應(yīng)急安全管理的國際公約、國際核損害法律責(zé)任的公約以及禁止和限制核武器的國際條約等。國外相關(guān)國家的核能安全立法已經(jīng)較為完善。我國核安全政策存在體系結(jié)構(gòu)不完善的缺陷,論文從完善立法結(jié)構(gòu)等方面對完善我國核安全政策提出了具體建議。
[Abstract]:Because of the increasingly tense energy, the development and use of nuclear energy has become an important aspect of social and economic development.Throughout the history of nuclear energy development, nuclear safety has always been the most concerned by the public.In the 21 century, as China's economic development accelerated, energy consumption was enormous. In order to meet the growing demand for energy for economic and social development, and to alleviate the situation of excessive dependence on foreign energy,China has formulated a policy of vigorously developing nuclear energy, which has aroused the people's close attention to the issue of nuclear safety.Ensuring the safe use of nuclear energy is a systematic work that requires a wide range of legal, educational, technological and other means.As a kind of social norm that adjusts the relationship between people and people, policy plays a special role.It is of great theoretical and practical significance to further strengthen the research on international and foreign nuclear safety policies in order to ensure the safety of nuclear energy in China and to perfect the legal system of environmental protection in China.On the basis of summing up international law and domestic law in the field of nuclear safety, this paper summarizes the characteristics of international legal system on nuclear safety and the legislation of nuclear safety in China, and points out the shortcomings and the ways to perfect it.Nuclear energy refers to the energy released when the atomic structure changes. The development and utilization of nuclear energy include military and civil. Its safety problems mainly lie in the harmful effects of nuclear radiation and nuclear waste on the environment in the process of nuclear energy utilization.International nuclear energy safety legislation includes the international convention on the management of radioactive waste, the international convention on the safety management of nuclear accident emergency, the international convention on legal liability for nuclear damage, and the international treaty prohibiting and limiting nuclear weapons, etc.The nuclear energy safety legislation of relevant foreign countries has been relatively perfect.The nuclear safety policy of our country has the defect of imperfect system structure. This paper puts forward some concrete suggestions to perfect our nuclear safety policy from the aspects of consummating the legislative structure and so on.
