【摘要】： 聯(lián)合國(guó)集體安全機(jī)制是聯(lián)合國(guó)體系的核心,是維護(hù)世界和平與穩(wěn)定的最重要的國(guó)際機(jī)制,在制度設(shè)計(jì)上較國(guó)際聯(lián)盟有了長(zhǎng)足的進(jìn)展。經(jīng)過二戰(zhàn)后60多年的實(shí)踐歷程,聯(lián)合國(guó)集體安全機(jī)制在處理世界和平危機(jī)事件中發(fā)揮了不可替代的積極作用。 冷戰(zhàn)結(jié)束后,全球面臨的傳統(tǒng)安全威脅依然存在,主要表現(xiàn)在：局部戰(zhàn)爭(zhēng)和武裝沖突保持高發(fā)態(tài)勢(shì),以新軍事變革為核心的世界軍事競(jìng)爭(zhēng)日益激烈,核擴(kuò)散和軍備控制形勢(shì)依然嚴(yán)峻。這些傳統(tǒng)安全威脅使聯(lián)合國(guó)集體安全機(jī)制面臨新的挑戰(zhàn)：集體安全共識(shí)受到的沖擊,限制使用武力的國(guó)際法規(guī)則受到?jīng)_擊,聯(lián)合國(guó)集體安全保障機(jī)制的集體強(qiáng)制力面臨挑戰(zhàn)。在應(yīng)對(duì)傳統(tǒng)安全威脅的實(shí)踐中,決策機(jī)制、維和機(jī)制、裁軍與軍控機(jī)制存在諸多困境,制約著該機(jī)制作用的發(fā)揮。聯(lián)合國(guó)集體安全機(jī)制具有天然的內(nèi)在局限性與客觀的外在制約因素,是導(dǎo)致聯(lián)合國(guó)集體安全機(jī)制存在諸多困境的主要原因。為了擺脫聯(lián)合國(guó)集體安全機(jī)制的困境,我們從宏觀、微觀兩方面改革與創(chuàng)新聯(lián)合國(guó)集體安全決策機(jī)制、維和機(jī)制和裁軍與軍控機(jī)制,使之在處理國(guó)際安全問題時(shí),發(fā)揮及時(shí)有效的作用。通過對(duì)聯(lián)合國(guó)集體安全機(jī)制改革的思考,可以預(yù)見,改革將使聯(lián)合國(guó)集體安全機(jī)制的效力范圍擴(kuò)大,聯(lián)合國(guó)集體安全機(jī)制的運(yùn)行能力得到提高,“區(qū)域辦法”得到規(guī)范并強(qiáng)化。完善聯(lián)合國(guó)集體安全機(jī)制,將成為其未來作用發(fā)揮的基本前提。
[Abstract]:The United Nations collective security mechanism is the core of the United Nations system and the most important international mechanism for maintaining world peace and stability. The United Nations collective security mechanism has played an irreplaceable role in dealing with world peace crises. After the end of the Cold War, the traditional security threats to the whole world still exist, mainly manifested in the high incidence of local wars and armed conflicts, and the increasingly fierce military competition in the world with the new military transformation as the core. The situation of nuclear proliferation and arms control remains grave. These traditional security threats present new challenges to the collective security machinery of the United Nations: the impact on the collective security consensus and the impact on the rules of international law restricting the use of force, The collective coercive power of the United Nations collective security guarantee mechanism faces challenges. In the practice of dealing with traditional security threats, there are many dilemmas in decision-making mechanisms, peacekeeping mechanisms, disarmament and arms control mechanisms. The United Nations collective security mechanism has natural inherent limitations and objective external constraints, In order to get rid of the predicament of the collective security mechanism of the United Nations, we have reformed and innovated the decision-making mechanism of collective security of the United Nations in macro and micro aspects. Peacekeeping mechanisms and disarmament and arms control mechanisms, which enable them to play a timely and effective role in dealing with international security issues... can be foreseen through reflection on the reform of the collective security machinery of the United Nations, The reform will expand the scope of effectiveness of the United Nations collective security mechanism, enhance the operational capacity of the United Nations collective security mechanism, standardize and strengthen the "regional approach"... improve the United Nations collective security mechanism, Will become its future role to play the basic premise.
