【摘要】：解決國際協(xié)定的遵約困境,是保障國際公共產(chǎn)品供給的必要前提。阻礙遵約的因素不僅包括意愿也包括能力。供給國促使缺乏遵約能力的對象國讓渡部分執(zhí)法權(quán),代其履行協(xié)定義務(wù),是遵約困境的一種解決模式。與長期經(jīng)濟(jì)依賴和傳統(tǒng)盟友關(guān)系相比,由節(jié)點(diǎn)事件導(dǎo)致的對象國對供給國的短期政治依賴,是促成執(zhí)法權(quán)讓渡的關(guān)鍵因素。而在對象國政治依賴降低,且沒有第三方大國干涉的情況下,供給國可能單方面選擇強(qiáng)制措施。在19世紀(jì)英國主導(dǎo)的國際反販奴協(xié)定體系中,英國為解決與葡萄牙、西班牙、巴西和古巴等國間雙邊協(xié)定中的遵約困境,采取了外交勸服和單邊強(qiáng)制等措施。因此,國際公共產(chǎn)品戰(zhàn)略需超越以投資和援助為主的單一經(jīng)濟(jì)手段,協(xié)調(diào)運(yùn)用多種政策工具。
[Abstract]:To resolve the compliance dilemma of international agreements is a necessary prerequisite for safeguarding the supply of international public goods. The obstacles to compliance include not only willingness but also capacity. The supplier country impedes the transfer of part of the enforcement power by the target country that lacks the compliance capacity. Acting on its obligations under the agreement is a solution to its compliance dilemma. Compared with long-term economic dependence and traditional alliances, the short-term political dependence of the target country on the supplier country is due to node events. This is a key factor contributing to the transfer of law enforcement power. In the case of a reduced political dependence on the part of the target country and without the intervention of a third country, the supplier country may unilaterally opt for coercive measures. In the international anti-slavery agreement system led by Britain in 19th century, Britain has taken diplomatic persuasion and unilateral enforcement measures to resolve the compliance dilemma in bilateral agreements with Portugal, Spain, Brazil and Cuba. The international public product strategy should go beyond the single economic means of investment and aid, and coordinate the use of various policy instruments.
