【摘要】:婚姻關(guān)系是人類社會(huì)所特有的生存形式,是人類社會(huì)關(guān)系中最基本的關(guān)系之一。在婚姻家庭關(guān)系中,女性的存在是不可或缺的,但是從整個(gè)歷史發(fā)展來看,直到近代社會(huì),女性的婚姻權(quán)利才得到重視。隨著社會(huì)的發(fā)展,重視女性的婚姻權(quán)利已成為建設(shè)人權(quán)的必經(jīng)之路?v觀中國(guó)女性婚姻權(quán)利在不同社會(huì)經(jīng)濟(jì)結(jié)構(gòu)中的發(fā)展變化,大體分為兩個(gè)階段:第一個(gè)階段,在封建社會(huì)中,女性經(jīng)濟(jì)依附于男性,社會(huì)婚姻權(quán)利總體呈現(xiàn)的一個(gè)特征是男尊女卑。傳統(tǒng)社會(huì)中,女性由于經(jīng)濟(jì)上的不獨(dú)立,婚姻權(quán)利都是圍繞男性權(quán)利進(jìn)行變動(dòng),主要目的是為了維護(hù)“男權(quán)社會(huì)”的穩(wěn)定。男性統(tǒng)治者根據(jù)自己的統(tǒng)治需要,從制度上建立了男女明確的行為標(biāo)準(zhǔn),形成不同的等級(jí)秩序;另外,固化的男女關(guān)系,使人們形成思維習(xí)慣,女性沒有自主意識(shí),長(zhǎng)期受男性奴役。第二個(gè)階段,在近代社會(huì)中,女性經(jīng)濟(jì)逐漸獨(dú)立,開始追求男女平等。從太平天國(guó)時(shí)期開始,中國(guó)女性追求平等的自主意識(shí)開始萌芽,隨之而來的戊戌變法、五四運(yùn)動(dòng)等資產(chǎn)階級(jí)民主革命,推動(dòng)了女性追求男女平等原則的進(jìn)程。直到中國(guó)共產(chǎn)黨執(zhí)政后,女性婚姻權(quán)利的發(fā)展才進(jìn)入新的階段。改革開放的實(shí)行,市場(chǎng)經(jīng)濟(jì)的發(fā)展,女性的經(jīng)濟(jì)地位越來越高,相應(yīng)的男女婚姻權(quán)利也越來越平等,但傳統(tǒng)的男尊女卑思想仍沒有磨滅。本文主要探討女性婚姻權(quán)利與社會(huì)經(jīng)濟(jì)之間的關(guān)系。從女性對(duì)男性的依附程度來講,包括依附與非依附兩種狀態(tài),在兩種不同的狀態(tài)下產(chǎn)生了不同的女性婚姻權(quán)利。第一章主要介紹在女性經(jīng)濟(jì)依附于男性經(jīng)濟(jì)關(guān)系中,女性婚姻權(quán)利的表現(xiàn)形式。在經(jīng)濟(jì)依附關(guān)系中,主要存在個(gè)人對(duì)個(gè)人的依附和個(gè)人對(duì)組織的依附兩種情形。在個(gè)人對(duì)個(gè)人的經(jīng)濟(jì)依附狀態(tài)下,女性的婚姻權(quán)利主要呈現(xiàn)出兩種情形,一種是貫穿整個(gè)封建社會(huì)的表現(xiàn)形式即男尊女卑。女性的婚姻權(quán)利最終都鞏固和維護(hù)這一思想,女性完全是男性的附庸。另一種在封建社會(huì)中出現(xiàn)了“初夜權(quán)”分享的極端情形,女性的“初夜權(quán)”成為了男性霸權(quán)的犧牲品。在個(gè)人對(duì)組織的經(jīng)濟(jì)依附狀態(tài)下,女性婚姻權(quán)利則是根據(jù)當(dāng)時(shí)中國(guó)共產(chǎn)黨革命需要在隨時(shí)變化,女性婚姻成為了中國(guó)共產(chǎn)黨維系與革命軍關(guān)系的工具。第二章主要介紹了在逐步實(shí)現(xiàn)兩性經(jīng)濟(jì)平等過程中,女性的婚姻地位雖然相較傳統(tǒng)社會(huì)已有一定提高,但封建倫理對(duì)女性的影響并沒有立刻消失。另外伴隨著市場(chǎng)經(jīng)濟(jì)的逐步完善,女性的婚姻又更多地經(jīng)受金錢、市場(chǎng)的考驗(yàn)。同一時(shí)期,同性婚姻也開始從幕后走向臺(tái)前,開始有更多的人為同性婚姻權(quán)利奔走,也相繼有更多的西方國(guó)家開始立法肯定。第三章則是將婚姻權(quán)利做了工具性考量,探討其在作為手段和目的情形下與經(jīng)濟(jì)、人身的關(guān)系。通過對(duì)這一過程的簡(jiǎn)單分析,可以更清晰地觀察到女性婚姻權(quán)利隨著經(jīng)濟(jì)地位的變化特點(diǎn),為將來兩性的實(shí)質(zhì)平等研究提供一個(gè)參考方向。
[Abstract]:Marriage is unique to the survival of human society, is one of the most basic relations of human society relationship.
