【摘要】：改革開(kāi)放以來(lái),我國(guó)經(jīng)濟(jì)迅猛發(fā)展,綜合國(guó)力極大提升,其中,城鎮(zhèn)化是主要?jiǎng)右颉ｋS著城鎮(zhèn)化的深入推進(jìn),征地拆遷成為熱議話題,被打上了"不滿、摩擦、沖突"等時(shí)代標(biāo)簽,無(wú)形中被推上了眾矢之的的風(fēng)口浪尖,現(xiàn)階段更成為與勞資糾紛和社會(huì)保障糾紛并提的三大社會(huì)矛盾之一,特別是其中事關(guān)億萬(wàn)農(nóng)村人口的宅基地房屋拆遷問(wèn)題,處理起來(lái)最為復(fù)雜,對(duì)應(yīng)的社會(huì)關(guān)注度也最高。因此,妥善處理好宅基地房屋拆遷所涉及的各類(lèi)矛盾是現(xiàn)階段需要重點(diǎn)攻克的難題。第一部分是論文的緒論部分。該部分作為文章的綱目,對(duì)論文的選題背景、研究意義、國(guó)內(nèi)和國(guó)外研究現(xiàn)狀、研究方法、技術(shù)路線及創(chuàng)新與不足等逐一闡述。第二部分是論文的研究理論基礎(chǔ)。對(duì)涉及的相關(guān)概念進(jìn)行解讀,重點(diǎn)闡述風(fēng)險(xiǎn)社會(huì)理論、社會(huì)治理理論、社會(huì)保障理論、博弈論等研究所涉及的理論依據(jù)。第三部分是結(jié)合權(quán)益保障對(duì)南京市宅基地房屋拆遷相關(guān)政策的歷史做深入分析。首先,闡述歷年來(lái)南京市征收集體土地涉及房屋的拆遷政策及其變化;其次,通過(guò)理論分析與數(shù)據(jù)比較,論述多輪政策調(diào)整后現(xiàn)階段權(quán)益保障的相關(guān)情況。第四部分是宅基地房屋拆遷問(wèn)題的權(quán)益保障分析。一是進(jìn)行實(shí)地調(diào)研并對(duì)座談?dòng)涗涀鰵w納總結(jié),分析存在的普遍問(wèn)題,重點(diǎn)闡述未征先拆現(xiàn)象;二是就拆遷問(wèn)題中的補(bǔ)償環(huán)節(jié)做專(zhuān)項(xiàng)研究,通過(guò)江心洲地塊個(gè)案的剖析,對(duì)補(bǔ)償現(xiàn)狀的不足癥結(jié)進(jìn)行提煉,并對(duì)特殊問(wèn)題撤組剩余國(guó)有地塊補(bǔ)償政策適用合理性問(wèn)題展開(kāi)論述;最后,以權(quán)益保障為切入點(diǎn)就其中存在的主要問(wèn)題及內(nèi)在矛盾做深入分析。第五部分是解決宅基地房屋拆遷問(wèn)題的對(duì)策建議。具體解決路徑主要是從拆遷立法、市場(chǎng)評(píng)估、可持續(xù)性保障、體制革新及自主自治四個(gè)方面加以綜合考慮。第六部分是論文的結(jié)論部分。對(duì)論文的研究?jī)?nèi)容進(jìn)行總結(jié)。宅基地房屋拆遷問(wèn)題是城鎮(zhèn)化建設(shè)所必須面對(duì)的現(xiàn)實(shí)問(wèn)題和長(zhǎng)遠(yuǎn)規(guī)劃,處理失當(dāng)甚至將影響社會(huì)穩(wěn)定和政治安定大局。以此為研究,一方面希望通過(guò)理論分析、數(shù)據(jù)分析結(jié)合實(shí)地調(diào)研的方式,深入挖潛宅基地房屋拆遷沖突產(chǎn)生的內(nèi)因并探索解決路徑。另一方面也是為了能夠?qū)Σ疬w操作實(shí)務(wù)的導(dǎo)向有所啟發(fā)和引領(lǐng)。
[Abstract]:Since the reform and opening up, China's rapid economic development, comprehensive national strength is greatly improved, among which, urbanization is the main motivation. With the further development of urbanization, land requisition and relocation has become a hot topic, labeled "discontent, friction, conflict" and so on. At the present stage, it has become one of the three social contradictions with labor disputes and social security disputes, especially the problem of house demolition and relocation involving hundreds of millions of rural population, which is the most complex to deal with, and the corresponding social attention is the highest. Therefore, properly handling all kinds of contradictions involved in the demolition of homestead houses is a difficult problem that needs to be solved at this stage. The first part is the introduction of the paper. This part, as the outline of the article, expounds the background, significance, domestic and foreign research status, research methods, technical route, innovation and deficiency of the thesis. The second part is the theoretical basis of the thesis. The related concepts are interpreted, and the theoretical basis of risk society theory, social governance theory, social security theory, game theory and so on are expounded. The third part is an in-depth analysis of the history of housing demolition and relocation policies in Nanjing in combination with the protection of rights and interests. First of all, this paper expounds the demolition policy and its changes of the collective land expropriation in Nanjing over the years. Secondly, through theoretical analysis and data comparison, this paper discusses the relevant situation of the protection of rights and interests at the present stage after the multi-round policy adjustment. The fourth part is the homestead house demolition rights and interests protection analysis. The first is to carry on the field investigation and summarize the record of the discussion, analyze the existing general problems, and focus on the phenomenon of uncollected and first removed; The second is to do special research on compensation link in demolition and relocation, through the analysis of Jiangxinzhou land block case, to refine the deficiency of the compensation status, and to discuss the rationality of the compensation policy of the special problem to be withdrawn from the remaining state-owned land; Finally, the paper analyzes the main problems and internal contradictions from the point of view of the protection of rights and interests. The fifth part is to solve the homestead house demolition problem countermeasure suggestion. The concrete solution is mainly considered from four aspects: relocation legislation, market evaluation, sustainability guarantee, institutional innovation and autonomous autonomy. The sixth part is the conclusion of the paper. The research content of this paper is summarized. The problem of house demolition and relocation is a realistic problem and long-term planning that must be faced in the construction of urbanization. Improper handling will even affect the overall situation of social stability and political stability. On the one hand, it is hoped that through theoretical analysis, data analysis and field investigation, the paper will explore the internal causes of house demolition conflicts and explore the solutions. On the other hand, it is also in order to be able to open the practice of practical guidance and guidance.
