【摘要】：我國(guó)社會(huì)保障制度的形成與發(fā)展始終被視為再分配的一種工具和手段，試圖縮小收入差距。特別是當(dāng)下正義理念的提出更加推動(dòng)了這一趨勢(shì)。然而，正義是否等同于結(jié)果的平等，是否意味著劫富濟(jì)貧，是否應(yīng)由特定的主體來(lái)判定。顯然，目前學(xué)界尚未給予明確地回應(yīng)和翔實(shí)地闡釋，導(dǎo)致對(duì)制度轉(zhuǎn)軌中呈現(xiàn)的多方面問(wèn)題無(wú)法進(jìn)行根源性的反思。因此，筆者認(rèn)為有必要以規(guī)范性的正義觀作為研究的視角，來(lái)考察制度背后的價(jià)值準(zhǔn)則是否合乎正義，反思現(xiàn)行制度是否良好地踐行了正義的核心原則。 本文主要是通過(guò)對(duì)相關(guān)經(jīng)典文獻(xiàn)的閱讀和比較，，向前追溯正義內(nèi)涵的發(fā)展歷程，并以有限理性和制度演化為理論基礎(chǔ)，綜合得出規(guī)范意義上的正義觀，繼而將其融入到社會(huì)保障制度的研究中。筆者發(fā)現(xiàn)，合乎正義的社會(huì)保障制度應(yīng)該以不侵犯他人財(cái)產(chǎn)和自由為首要前提，提供有限的、規(guī)則平等的遵循市場(chǎng)競(jìng)爭(zhēng)機(jī)制的多元主體的保障形式。遺憾的是，我國(guó)社會(huì)保障制度恰恰表現(xiàn)出與這些準(zhǔn)則相違的各種非正義。最大的問(wèn)題恐怕在于單中心治理模式下的強(qiáng)制繳費(fèi)與再分配的擴(kuò)大化。因此，筆者認(rèn)為當(dāng)下我們急需扭轉(zhuǎn)與化解制度的畸形狀態(tài)，特別是以正義原則作為依據(jù)，提出了若干解決思路。
[Abstract]:The formation and development of China's social security system has always been regarded as a tool and means of redistribution in an attempt to narrow the income gap. In particular, the concept of justice in the present put forward even more to promote this trend. However, whether justice is equal to equality of results, whether it means robbing the rich and helping the poor, should be judged by specific subjects. Obviously, the academic circles have not given a clear response and detailed explanation at present, which leads to the failure to reflect on the root causes of the various problems in the system transition. Therefore, the author thinks that it is necessary to take the normative view of justice as the research angle to examine whether the value criterion behind the system conforms to justice, and to reflect on whether the current system has carried out the core principles of justice. Through reading and comparing the relevant classical literature, this paper traces the development course of the connotation of justice, and based on the theory of limited rationality and institutional evolution, synthesizes the concept of justice in the sense of norm. Then it will be incorporated into the study of social security system. The author finds that a just social security system should be based on the premise of not infringing upon the property and freedom of others, and provide a limited, regular and equal form of protection for multiple subjects who follow the mechanism of market competition. Unfortunately, the social security system of our country just shows the injustice that disobeys these norms. The biggest problem is the expansion of mandatory payment and redistribution under the single-center governance model. Therefore, the author believes that we urgently need to reverse and resolve the malformation of the system, especially on the basis of the principle of justice, and put forward some solutions.
