【摘要】:隨著農(nóng)村土地流轉(zhuǎn)規(guī)模的日益擴(kuò)大以及新一輪農(nóng)地改革的推進(jìn),我國農(nóng)村土地流轉(zhuǎn)市場(chǎng)將迎來新的發(fā)展機(jī)遇。尤其在農(nóng)村土地流轉(zhuǎn)實(shí)踐中,出現(xiàn)了土地承包主體與土地經(jīng)營權(quán)主體逐漸分離的趨勢(shì),農(nóng)村土地流轉(zhuǎn)“三權(quán)分置”的模式應(yīng)運(yùn)而生。但從現(xiàn)階段來看,我國有關(guān)土地承包經(jīng)營權(quán)流轉(zhuǎn)的法律制度并不健全,尤其《中華人民共和國物權(quán)法》(以下簡稱《物權(quán)法》)及《中華人民共和國農(nóng)村土地承包法》(以下簡稱《農(nóng)村土地承包法》)等法律對(duì)土地承包經(jīng)營權(quán)流轉(zhuǎn)的諸多限制性規(guī)定亟待修改、完善。一方面,由于實(shí)踐中農(nóng)村土地所有權(quán)主體不明確,土地承包經(jīng)營權(quán)的流轉(zhuǎn)程序極不規(guī)范,土地流轉(zhuǎn)糾紛的解決機(jī)制不完善,旨在服務(wù)土地流轉(zhuǎn)市場(chǎng)的中介組織及社會(huì)保障制度極度匱乏,一定程度上造成了農(nóng)村土地流轉(zhuǎn)市場(chǎng)亂象叢生;另一方面,我國法律對(duì)“土地承包權(quán)”“土地經(jīng)營權(quán)”未加以確認(rèn),對(duì)土地流轉(zhuǎn)方式的規(guī)定混亂等,這些都極大損害了我國法律的科學(xué)性以及嚴(yán)謹(jǐn)性。通過對(duì)湖南省“兩型社會(huì)”建設(shè)改革試驗(yàn)區(qū)——湘潭昭山示范區(qū)展開實(shí)地調(diào)研,結(jié)合中央提出的土地流轉(zhuǎn)“三權(quán)分置”政策理論,針對(duì)當(dāng)前我國土地承包經(jīng)營權(quán)流轉(zhuǎn)中存在的諸多問題,指出未來我國應(yīng)加快對(duì)土地承包經(jīng)營權(quán)制度的完善:一方面,要加快土地確權(quán)工作,將農(nóng)村土地集體所有的制度落到實(shí)處;另一方面,要盡快完善我國有關(guān)土地法律法規(guī),明確“土地承包權(quán)”“土地經(jīng)營權(quán)”的內(nèi)涵及法律地位,修改有關(guān)土地流轉(zhuǎn)方式的概念及模糊性規(guī)定;同時(shí),在實(shí)踐中,要不斷探索建立與土地流轉(zhuǎn)相配套的各項(xiàng)機(jī)制,如充分發(fā)揮中介組織的服務(wù)職能,建立健全多元化的糾紛解決方式,完善農(nóng)村社會(huì)保障制度等。改革須依法而行,通過法律來有效規(guī)制農(nóng)村土地流轉(zhuǎn)行為,引導(dǎo)農(nóng)村土地流轉(zhuǎn)進(jìn)入健康、有序、良性循環(huán)的發(fā)展軌道,是我國實(shí)行依法治國的必然要求。繼農(nóng)地改革之后,我國必然會(huì)從立法和實(shí)踐兩方面逐步完善我國土地承包經(jīng)營權(quán)流轉(zhuǎn)制度。
[Abstract]:With the increasing scale of rural land circulation and the promotion of a new round of rural land reform, the rural land transfer market in China will usher in new opportunities for development. Especially in the practice of rural land circulation, there is a trend that the main body of land contract and the main body of land management right are separated gradually, and the mode of "three rights division" of rural land circulation arises at the historic moment. However, from the point of view of the present stage, the legal system concerning the transfer of land contractual management rights in our country is not perfect. In particular, the Law of the people's Republic of China on property Rights (hereinafter referred to as "the Law on Real Rights") and the Law of the people's Republic of China on Rural Land contract (hereinafter referred to as the "Law on Rural Land contract") and other laws have many restrictions on the transfer of the right to contract and manage land. The regulations are in urgent need of revision. Perfect. On the one hand, because the main body of rural land ownership is not clear in practice, the transfer procedure of land contract management right is extremely irregular, and the settlement mechanism of land transfer dispute is not perfect. In order to serve the land transfer market, the intermediary organizations and the social security system are extremely scarce, to a certain extent, the rural land transfer market is chaotic; on the other hand, The law of our country has not confirmed the "land contract right" and "the land management right", and the regulations of the land circulation mode are confused, all of these have greatly damaged the scientific nature and rigor of the law of our country. Through the field investigation on the pilot area of "two-oriented society" construction reform in Hunan Province, the Zhaoshan demonstration area of Xiangtan, combined with the policy theory of "three rights division" put forward by the central government, In view of the problems existing in the transfer of the land contractual management right in our country at present, it is pointed out that in the future China should speed up the perfection of the land contract management right system: on the one hand, it is necessary to speed up the work of confirming the right of land management. The system of collective ownership of rural land should be put into practice; on the other hand, it is necessary to improve the relevant land laws and regulations as soon as possible, and make clear the connotation and legal status of "land contract right" and "land management right". At the same time, in practice, it is necessary to constantly explore the establishment of various mechanisms matching the land circulation, such as giving full play to the service functions of intermediary organizations, To establish and improve diversified dispute resolution, improve the rural social security system and so on. The reform must be carried out in accordance with the law. It is necessary to regulate the rural land circulation effectively and guide the rural land circulation into a healthy, orderly and virtuous development track, which is the inevitable requirement for our country to run the country according to law. After the reform of agricultural land, our country will gradually perfect the circulation system of land contract management right from the aspects of legislation and practice.
