【摘要】：醫(yī)療保險(xiǎn)作為社會(huì)保障的重要組成部分,其法律體系建設(shè)依然存在立法滯后、層次較低、執(zhí)法主體不協(xié)調(diào)、程序不規(guī)范和司法救濟(jì)嚴(yán)重錯(cuò)位等諸多問(wèn)題。因此,應(yīng)抓住全面推進(jìn)依法治國(guó)的重要機(jī)遇,推動(dòng)我國(guó)醫(yī)療保險(xiǎn)法律體系的發(fā)展與改革。本文在梳理我國(guó)醫(yī)療保險(xiǎn)法律體系發(fā)展歷程的基礎(chǔ)上,提出了立法層次向上集中、加快單項(xiàng)專(zhuān)項(xiàng)立法進(jìn)程、探索建立個(gè)人信用體系和明確并公開(kāi)司法工作等對(duì)策建議,以促進(jìn)醫(yī)療保險(xiǎn)法律體系的完善。
[Abstract]:As an important part of social security, the construction of medical insurance legal system still has many problems, such as legislation lagging behind, low level, the main body of law enforcement is not coordinated, the procedure is not standardized and the judicial remedy is seriously misplaced, and so on. Therefore, we should seize the important opportunity to advance the rule of law in an all-round way and promote the development and reform of the legal system of medical insurance in China. On the basis of combing the development course of China's medical insurance legal system, this paper puts forward some countermeasures and suggestions, such as centralizing the legislative level, speeding up the process of individual special legislation, exploring the establishment of personal credit system and clarifying and publicizing the judicial work, etc. In order to promote the improvement of the legal system of medical insurance.
