【摘要】：隨著工業(yè)化和城市化的快速發(fā)展,我國社會經(jīng)濟結(jié)構(gòu)發(fā)生了根本性的改變,社會經(jīng)濟水平不斷提高。但伴隨工業(yè)化和城市化的不斷加快,社會發(fā)展對建設用地的需求不斷增多,必然會帶來大量的農(nóng)村土地被征收。就我國目前的現(xiàn)實來看,由于制度原因和失地農(nóng)民自身素質(zhì)等原因的限制,農(nóng)民對于土地征收制度非常不滿。為保護自身利益,失地農(nóng)民往往采取一些過激手段,影響到社會的和諧穩(wěn)定。經(jīng)濟的發(fā)展不能以犧牲農(nóng)民的利益為代價,如何保障失地農(nóng)民的權(quán)益已經(jīng)成為一個令人關注的社會問題。本文借鑒國內(nèi)外保護失地農(nóng)民的立法和相關理論,在分析福建省南安市調(diào)查數(shù)據(jù)的基礎上,提出農(nóng)民失地后所面臨的問題。從法律和制度層面分析問題產(chǎn)生的原因,并提出解決失地農(nóng)民利益受損的措施。研究結(jié)果如下：(1)失地農(nóng)民失地后要面臨的一系列問題。通過對南安市失地農(nóng)民的調(diào)查數(shù)據(jù)分析,得出失地農(nóng)民征地后主要面臨著生活水平下降、再就業(yè)困難、保障內(nèi)容單一且保障水平低等問題。(2)從法律和制度層面對失地農(nóng)民利益受損的原因進行分析,得出失地農(nóng)民利益受損的根本原因是土地產(chǎn)權(quán)界定不清,直接原因是由于現(xiàn)行的土地征收制度不合理。農(nóng)地征收程度不合理和社會保障制度的缺陷也是失地農(nóng)民利益受損的重要原因。(3)提出解決失地農(nóng)民利益受損的措施。借鑒經(jīng)濟發(fā)達國家和地區(qū)保障失地農(nóng)民權(quán)益的經(jīng)驗,結(jié)合我國的國情提出保障我國失地農(nóng)民權(quán)益的合理化建議：一是完善農(nóng)地產(chǎn)權(quán)制度；二是完善土地征收制度；三是完善社會保障制度。
[Abstract]:With the rapid development of industrialization and urbanization, the social and economic structure of our country has undergone fundamental changes, and the level of social economy has been continuously improved. However, with the acceleration of industrialization and urbanization, the demand for construction land is increasing in social development, which will inevitably lead to a large number of rural land expropriation. As far as the reality of our country is concerned, the peasants are very dissatisfied with the land expropriation system because of the limitation of the system and the quality of the landless farmers. In order to protect their own interests, landless farmers often take some drastic measures to affect the social harmony and stability. Economic development can not be at the expense of farmers' interests. How to protect the rights and interests of landless farmers has become a social problem that people pay close attention to. Based on the analysis of the investigation data of Nanan City in Fujian Province, this paper draws lessons from the legislation and related theories of protecting land-losing farmers at home and abroad, and puts forward the problems that farmers will face after losing their land. This paper analyzes the causes of the problems from the legal and institutional aspects, and puts forward some measures to solve the damage to the interests of landless farmers. The results are as follows: 1) A series of problems faced by landless farmers after losing their land. By analyzing the survey data of landless farmers in Nanan City, it is concluded that the landless peasants are mainly faced with a decline in their living standards and difficulties in obtaining employment after land requisition. This paper analyzes the causes of the loss of the interests of the land-losing farmers from the legal and institutional level, and concludes that the fundamental reason for the loss of the interests of the land-losing peasants is the unclear definition of the land property rights. The direct reason is that the current land expropriation system is unreasonable. The unreasonable expropriation of agricultural land and the defects of social security system are also the important reasons for the loss of the interests of landless farmers. Based on the experience of developed countries and regions in protecting the rights and interests of landless farmers, this paper puts forward some reasonable suggestions to protect the rights and interests of landless farmers: first, to perfect the system of farmland property rights, secondly, to perfect the system of land expropriation; Third, perfect the social security system.
