貴州省勞務(wù)派遣監(jiān)管法律機(jī)制實證研究

【摘要】:勞務(wù)派遣作為新的就業(yè)模式和用工形式對我國勞動領(lǐng)域產(chǎn)生了深遠(yuǎn)的影響,對我國經(jīng)濟(jì)的發(fā)展和就業(yè)多元化具有十分重要的作用。但是,由于勞動者和用人單位之間供求關(guān)系失衡及行政機(jī)關(guān)監(jiān)管工作不到位,勞務(wù)派遣工的合法權(quán)益得不到立法者預(yù)期的全面有效保護(hù)。那么勞務(wù)派遣監(jiān)管工作成效到底如何,還存在哪些問題需要解決,值得進(jìn)一步選定區(qū)域進(jìn)行調(diào)研和分析。2013年7月以及2014年4月,我國相繼出臺了《勞務(wù)派遣行政許可實施辦法》和《勞務(wù)派遣暫行規(guī)定》,對于經(jīng)營勞務(wù)派遣業(yè)務(wù)的單位的資質(zhì)以及違反規(guī)定所要承擔(dān)的法律責(zé)任做了明確的規(guī)定,同時也為行政機(jī)關(guān)如何監(jiān)管勞務(wù)派遣活動提供了較為全面的制度規(guī)范,行政機(jī)關(guān)在運用這些制度對勞務(wù)派遣活動進(jìn)行監(jiān)管時,會面臨哪些問題,存有哪些困境值得進(jìn)一步探討。本課題通過對貴州省勞務(wù)派遣用工現(xiàn)狀以及貴州省人力資源和社會保障廳在監(jiān)管勞務(wù)派遣活動所面臨的問題的調(diào)研,找出行政機(jī)關(guān)在勞務(wù)派遣監(jiān)管工作中所存在的問題,提出完善貴州省勞務(wù)派遣監(jiān)管制度的建議,促進(jìn)勞務(wù)派遣行業(yè)在貴州省不斷規(guī)范有序的發(fā)展,維護(hù)勞務(wù)派遣單位以及勞務(wù)派遣勞動者的合法權(quán)益。全文分為四個部分。首先,是闡述本課題的選題原由以及意義,主要從理論意義、實踐意義兩個方面來闡述勞務(wù)派遣監(jiān)管制度現(xiàn)狀對于貴州省勞務(wù)派遣監(jiān)管措施和發(fā)展方向所產(chǎn)生的重要意義。其次,是對調(diào)研的基本情況的介紹,主要包括選擇貴州省人社廳作為調(diào)研點的理由、調(diào)研經(jīng)過、調(diào)研方法。再次,是對調(diào)研數(shù)據(jù)的整理。最后,在調(diào)研數(shù)據(jù)整理的基礎(chǔ)上,分析貴州省勞務(wù)派遣監(jiān)管制度中存在的問題,并提出解決的對策。
[Abstract]:As a new employment mode and employment form, labor dispatch has a profound influence on the labor field of our country, and plays a very important role in the economic development and employment diversification of our country. However, due to the imbalance between supply and demand between workers and employers and the lack of supervision by administrative organs, the legitimate rights and interests of labor dispatch workers are not fully and effectively protected as expected by legislators. Well, how effective is the supervision of labor dispatch, and what problems remain to be solved, which are worthy of further research and analysis in selected regions. In July 2013 and April 2014, China has successively promulgated the measures for the implementation of Administrative Licensing of Labor dispatching and the interim provisions on Labor Dispatch, which has made clear provisions on the qualifications of the units operating the dispatch of labor services and the legal liabilities to be assumed in violation of the regulations. At the same time, it also provides a more comprehensive system for administrative agencies how to supervise labor dispatch activities. When administrative agencies use these systems to supervise labor dispatch activities, what problems will they face and what difficulties are worth further discussing. Through investigating the current situation of labor dispatch in Guizhou province and the problems faced by Guizhou Human Resources and Social Security Department in supervising labor dispatch activities, the paper finds out the problems existing in the supervision of labor dispatch by administrative organs. Some suggestions are put forward to improve the supervision system of labor dispatch in Guizhou province, to promote the development of labor dispatch industry in Guizhou Province, and to safeguard the legitimate rights and interests of labor dispatch units and labor dispatch workers. The full text is divided into four parts. First of all, it expounds the reason and significance of this topic, mainly from the theoretical significance, practical significance of the labor dispatch supervision system for Guizhou Province labor dispatch supervision measures and development direction of the importance of the significance. Secondly, it introduces the basic situation of the investigation, including the reasons for choosing Guizhou Provincial people's Social Service as the research point, the research process and the research methods. Again, is the collation of the survey data. Finally, on the basis of the investigation data, this paper analyzes the problems existing in the supervision system of labor dispatch in Guizhou province, and puts forward some countermeasures.
