【摘要】：本文從桑德爾提到的"電車難題"入手,從馬克思主義價(jià)值論的視角考察西方學(xué)者在解答"道德難題"和"公正悖論"上的得失。作者指出,"難題"的困境表明,由于概念與歷史實(shí)踐的脫節(jié),特別是存在于功利主義、自由主義、德性主義等理論中的價(jià)值獨(dú)斷主義傳統(tǒng),束縛了理論批判的視野,使思考陷入了規(guī)范沖突的"死結(jié)"。隨著全球化和構(gòu)建人類命運(yùn)共同體的趨勢(shì),我們需要超越價(jià)值獨(dú)斷主義,認(rèn)真面對(duì)價(jià)值規(guī)范的主體性特質(zhì),深入把握多元主體間的層次結(jié)構(gòu),并以主體權(quán)責(zé)統(tǒng)一到位的精準(zhǔn)化判斷,去突破傳統(tǒng)思維的局限,以形成適應(yīng)時(shí)代的道德和法律等價(jià)值思維和理念。
[Abstract]:This paper begins with Sandel's "tram puzzle" and examines the gains and losses of western scholars in solving "moral problems" and "paradox of justice" from the perspective of Marxist theory of value.The author points out that the dilemma of "difficult problems" shows that because of the disconnection between concept and historical practice, especially the tradition of value arbitrariness in utilitarianism, liberalism, virtue and other theories, it restricts the view of theoretical criticism.It makes thinking fall into the "dead knot" of the conflict of norms.With the trend of globalization and the construction of human destiny community, we need to transcend the arbitrariness of value, seriously face the subjective characteristics of value norms, and deeply grasp the hierarchical structure among multiple subjects.In order to break through the limitation of traditional thinking and to form the value thinking and idea of adapting to the times, this paper uses the accurate judgment of the unity of subject power and responsibility to break through the limitation of traditional thinking.
