網(wǎng)絡空間反恐國際合作問題研究

【摘要】：網(wǎng)絡恐怖主義是隨著網(wǎng)絡時代的發(fā)展而出現(xiàn)的。信息技術的革命,為世界和人們的生活帶來了新的體驗,也為恐怖主義活動提供了另一種更為隱蔽、便利的契機。網(wǎng)絡恐怖主義的出現(xiàn)是世界網(wǎng)絡發(fā)展的一大難題,如何平衡好網(wǎng)絡的發(fā)展和打擊網(wǎng)絡恐怖主義二者的關系,也成為了世界性的話題�？植乐髁x利用網(wǎng)絡之便,開展新型的恐怖活動,嚴重地威脅著許多國家的安全、社會的安定、人們的利益,具有明顯跨國性質(zhì)的網(wǎng)絡恐怖主義活動,關系到整個國際社會的秩序,也為飛速發(fā)展的網(wǎng)絡空間的安全帶來了隱患。國際社會致力于尋求防范和懲治網(wǎng)絡恐怖主義犯罪最好的方法,國際合作無疑是每個國家的最佳選擇。在充分尊重國家網(wǎng)絡主權的基礎上,國家間在網(wǎng)絡反恐的立法、執(zhí)法、司法方面進行合作交流,在聯(lián)合國的主持協(xié)調(diào)下進行網(wǎng)絡反恐的互利分工,讓每個國家都能積極參與到網(wǎng)絡反恐的國際合作行動中來,這樣才能匯聚全球最大的力量對抗網(wǎng)絡恐怖主義。本文通過歸納各國學者對網(wǎng)絡恐怖主義的定義,總結出網(wǎng)絡恐怖主義的概念和特征。在充分分析當前國際社會在網(wǎng)絡反恐方面成就和不足的基礎上,發(fā)掘網(wǎng)絡空間反恐在國際合作方面存在的問題。面對網(wǎng)絡恐怖主義這一世界毒瘤,從國際合作角度出發(fā),為網(wǎng)絡空間治理提供一條適合各國合作發(fā)展的道路。在具體的治理措施方面,以聯(lián)合國憲章為基本原則,國際合作為手段,從完善立法、加強執(zhí)法、捍衛(wèi)主權、發(fā)揮國際組織的作用、增強科技合作的方面,重點提出了打擊網(wǎng)絡恐怖主義的實現(xiàn)途徑。同時又結合中國近幾年在網(wǎng)絡空間反恐方面的立法及相關活動,對中國加強國際合作、打擊網(wǎng)絡恐怖主義提出幾點建議。
[Abstract]:The network terrorism appears with the development of the network age. The revolution in information technology has brought a new experience to the world and people's lives, and provided another opportunity for terrorism to be more covert and convenient. The emergence of network terrorism is a major problem in the development of the world's network. How to balance the development of the network with the fight against network terrorism has become a worldwide topic. Taking advantage of the network, terrorism carries out new types of terrorist activities, which seriously threaten the security of many countries, the stability of society, the interests of people, and the activities of cyberterrorism of a distinct transnational nature. Related to the order of the entire international community, but also for the rapid development of the security of cyberspace brought hidden dangers. The international community is committed to seeking the best way to prevent and punish the crime of cyberterrorism, and international cooperation is undoubtedly the best choice for every country. On the basis of full respect for national cyber-sovereignty, cooperation and exchange among countries in the areas of legislation, law enforcement and judicial administration of cyberterrorism, and the mutually beneficial division of labour in cyberterrorism under the auspices and coordination of the United Nations, So that every country can actively participate in the international cooperation in cyberterrorism, so that the world's largest force in the fight against cyberterrorism. This paper sums up the concept and characteristics of cyberterrorism by summing up the definitions of cyberterrorism. Based on the full analysis of the current achievements and shortcomings of the international community in cyberterrorism, this paper explores the problems existing in international cooperation in cyberspace counter-terrorism. In the face of the world cancer of cyberterrorism, from the angle of international cooperation, it provides a path suitable for the cooperation and development of various countries in cyberspace governance. With regard to specific governance measures, with the UN Charter as the basic principle and international cooperation as a means, from the aspects of perfecting legislation, strengthening law enforcement, safeguarding sovereignty, giving play to the role of international organizations, and enhancing scientific and technological cooperation, The paper puts forward the way to combat network terrorism. At the same time, combined with China's anti-terrorism legislation and related activities in cyberspace in recent years, some suggestions are put forward for China to strengthen international cooperation and combat cyberterrorism.
