【摘要】：雖然地方各級人大及其常委會多年來,在健全和完善人民代表大會制度,加強(qiáng)監(jiān)督工作方面進(jìn)行了積極有益的探索和實踐,取得了一定成績,但由于歷史沿革、制度設(shè)計和現(xiàn)實操作中的各種原因,監(jiān)督職能的實施仍然是一個薄弱環(huán)節(jié),監(jiān)督效果離憲法和法律的要求和人民群眾的期望還有一定差距。中國共產(chǎn)黨第十八屆中央委員會第三次全體會議(以下簡稱:黨的十八屆三中全會)對新時期人大工作提出了新任務(wù)新要求,如何進(jìn)一步適應(yīng)時代發(fā)展需要,與時俱進(jìn)推動人大工作創(chuàng)新,不斷提高人大監(jiān)督效力,已成為各級人大及其常委會、人大工作者和專家學(xué)者所需深入思考的問題。本文在現(xiàn)有國內(nèi)外關(guān)于人大監(jiān)督工作的理論研究和工作成果基礎(chǔ)之上,選取德陽市人大及其常委會作為個案研究對象,深入考察德陽市七屆人大及其常委會以來行使對“一府兩院”監(jiān)督職權(quán)的實際情況,充分運(yùn)用公共管理理論、民主監(jiān)督理論、績效管理理論等理論成果,從人大監(jiān)督的方式、程序和公開原則三個維度進(jìn)行研究,總結(jié)出德陽市人大及其常委會在推進(jìn)監(jiān)督工作創(chuàng)新,提高監(jiān)督效果上的有益經(jīng)驗,以及其仍然存在的如監(jiān)督方式運(yùn)用不夠充分、監(jiān)督程序還不夠完善、監(jiān)督公開原則體現(xiàn)不充分等問題和不足。同時,深入剖析原因,提出進(jìn)一步健全完善德陽市人大監(jiān)督機(jī)制,與時俱進(jìn)推動監(jiān)督工作創(chuàng)新的方法、途徑和建議,從而促進(jìn)德陽市人大監(jiān)督職能的進(jìn)一步發(fā)揮。本文通過研究,其問題解決的方案對相關(guān)地方具有一定的借鑒性,其研究成果對健全和完善地方人大監(jiān)督制度,促進(jìn)監(jiān)督職能發(fā)揮提供了參考和研究素材。
[Abstract]:Although the local people's congresses at various levels and their standing committees have made positive and beneficial exploration and practice in improving and perfecting the system of people's congresses and strengthening the work of supervision over the years, they have made certain achievements, but because of the historical evolution, The implementation of supervisory function is still a weak link for various reasons in system design and practical operation, and the effect of supervision is still far from the requirements of the Constitution and laws and the expectations of the people. The third Plenary session of the 18th Central Committee of the Communist Party of China (hereinafter referred to as the third Plenary session of the 18th CPC Central Committee) put forward new tasks and new requirements for the work of the people's Congress in the new period, and how to further meet the needs of the development of the times. It is necessary for people's congresses at all levels and their standing committees, people's congresses and experts and scholars to think deeply about the innovation of the work of the people's congresses and constantly improving the effectiveness of the supervision of the people's congresses. On the basis of the existing theoretical research and work results of the supervision work of the people's Congress at home and abroad, this paper selects Deyang City people's Congress and its standing Committee as the case study object. To investigate in depth the actual situation in Deyang City since the Seventh National people's Congress and its standing Committee exercised their supervisory powers over "one government, two courts", and to make full use of the theoretical achievements of public management theory, democratic supervision theory, performance management theory, etc., and from the way the people's Congress supervises them, From the three aspects of procedure and openness principle, this paper sums up the beneficial experience of Deyang people's Congress and its standing Committee in promoting the innovation of supervision work and improving the supervision effect, as well as its existing problems, such as insufficient use of supervision methods. The supervision procedure is not perfect enough, and the principle of supervision and publicity is inadequate and so on. At the same time, the paper analyzes the reasons, and puts forward the methods, ways and suggestions to improve the supervision mechanism of Deyang City people's Congress and promote the innovation of supervision work with the times, so as to promote the further development of the supervision function of the people's Congress of Deyang City. Through the research, the solution of the problem has certain reference to the relevant places, and its research results provide reference and research material for perfecting and perfecting the supervision system of the local people's Congress and promoting the function of supervision.
