【摘要】："平均地權(quán)"思想的提出既有孫中山對(duì)現(xiàn)實(shí)問(wèn)題的近思,也有對(duì)未來(lái)困境的遠(yuǎn)慮。憑依自然法觀點(diǎn)解構(gòu)封建地主的土地所有權(quán),切中"地權(quán)不均"是社會(huì)貧富兩極分化的癥結(jié)所在,證成地權(quán)是民生權(quán)。澄析其從"平均地權(quán)"到"耕者有其田"的理論轉(zhuǎn)向,到所有權(quán)與使用權(quán)分離的制度設(shè)置,孫中山試圖以社會(huì)平等的宏大敘事,揚(yáng)棄"有田同耕"絕對(duì)平均主義,吸納亨利·喬治"單稅論"主張,捍守自然正義一般原則,型構(gòu)一種更加可行的社會(huì)公平與正義樣態(tài)。本文運(yùn)用唯物史觀分析框架,詮釋平均地權(quán)這一思想蘊(yùn)含的"土地正義",回應(yīng)當(dāng)下中國(guó)工業(yè)化、城市化語(yǔ)境中土地法治的新要求,關(guān)鍵在于土地正義的發(fā)展與重構(gòu)。
[Abstract]:The idea of "average land ownership" is not only a reflection of Sun Zhongshan's realistic problems, but also a distant concern for future dilemmas. According to the view of natural law to deconstruct the land ownership of feudal landlords, "uneven land rights" is the crux of polarization between the rich and the poor. From the theory of "average land right" to "the tiller has his field", to the system setting of the separation of ownership and right of use, Sun Zhongshan tries to use the grand narrative of social equality to sublate the absolute egalitarianism of "farming with farmland". To absorb Henry George's theory of single tax, to defend the general principle of natural justice, and to construct a more feasible social equity and justice. This article uses the historical materialism analysis frame to explain the "land justice" contained in the thought of average land right, and to respond to the new request of land rule of law in the context of industrialization and urbanization in China, the key lies in the development and reconstruction of land justice.
