【摘要】：專屬經(jīng)濟區(qū)內(nèi)的航行自由研究具有重要的理論和現(xiàn)實意義。其理論爭議點涵蓋沿海國在其專屬經(jīng)濟區(qū)內(nèi)是否擁有對他國船只特別是軍用船只的"同意權(quán)"問題,以及有關(guān)《聯(lián)合國海洋法公約》和《聯(lián)合國憲章》對應(yīng)文本條款的闡釋爭論。同時,這一問題所引發(fā)的實踐問題則包括與航行自由相對應(yīng)的飛越自由問題和專屬經(jīng)濟區(qū)上空的防空識別區(qū)問題、專屬經(jīng)濟區(qū)內(nèi)的海洋科學(xué)研究問題和沿海國在專屬經(jīng)濟區(qū)內(nèi)所享有的剩余權(quán)利問題。為此,處理專屬經(jīng)濟區(qū)內(nèi)的航行自由問題需要選擇適當(dāng)?shù)姆蛇吔��；谧陨砗Ｑ蟀踩桶l(fā)展需要,中國應(yīng)對此問題持體系化且靈活性的應(yīng)對策略。
[Abstract]:The study of freedom of navigation in the exclusive economic zone has important theoretical and practical significance. Its theoretical controversy covers the question of whether a coastal State has a "right of consent" over vessels of other States, especially military vessels, within its exclusive economic zone, And the interpretation of the corresponding articles of the UN Convention on the Law of the Sea and the UN Charter. At the same time, the practical issues raised by this question include the freedom of overflight, which corresponds to freedom of navigation, and the question of the air defence identification zone over the exclusive economic zone, The issue of marine scientific research in the exclusive economic zone and the residual rights enjoyed by coastal States within the exclusive economic zone. Therefore, to deal with freedom of navigation in the exclusive economic zone requires the choice of appropriate legal boundaries. In view of its own maritime security and development needs, China should adopt a systematic and flexible strategy to deal with this problem.
