【摘要】：高效有序的公眾參是國(guó)家民主法治健全與否的集中體現(xiàn)。2014《中共中央關(guān)于全面推進(jìn)依法治國(guó)若干重大問(wèn)題的決定》中指出,依法治國(guó)的重要任務(wù)包含增強(qiáng)全民法治觀念,推進(jìn)社會(huì)法治建設(shè)。而尊重和保障人權(quán)是社會(huì)主義法治的基本原則。在新農(nóng)村建設(shè)過(guò)程中廣泛的推進(jìn)公眾參與,能夠保障新農(nóng)村建設(shè)中公民的基本民主權(quán)利,是表達(dá)農(nóng)民訴求的有效途徑,能夠推進(jìn)新農(nóng)村建設(shè)過(guò)程中民主法治工作的進(jìn)程,體現(xiàn)了依法治國(guó)的重要要求。以往在關(guān)于推進(jìn)公眾參與的相關(guān)研究中,焦點(diǎn)主要集中全國(guó)整體范圍的公眾參與,缺乏針對(duì)農(nóng)村領(lǐng)域推進(jìn)公眾參與的研究,關(guān)于公眾參與問(wèn)題的研究集中于宏觀意識(shí)方面與制度、途徑方面,缺乏具體問(wèn)題分析如以往的研究只是把公眾參與作為一項(xiàng)參與活動(dòng)缺乏對(duì)參與主體的具體劃分,沒(méi)有研究各類(lèi)參與主體存在的不同問(wèn)題,而得出的一般普遍結(jié)論為公眾參與在中國(guó)存在門(mén)檻過(guò)高、參與信息不健全、參與渠道缺失等問(wèn)題。本文在科學(xué)調(diào)研的基礎(chǔ)上主要要采用問(wèn)卷調(diào)查與訪談的研究方法,針對(duì)安徽省在新農(nóng)村建設(shè)中的公眾參與問(wèn)題進(jìn)行研究并形成論文。在調(diào)研與寫(xiě)作過(guò)程中,結(jié)合相關(guān)學(xué)者的研究成果,在研究新農(nóng)村建設(shè)中存在一般問(wèn)題的基礎(chǔ)上,重點(diǎn)尋找新農(nóng)村建設(shè)中公眾參與主體存在的問(wèn)題,并集中分析新農(nóng)村建設(shè)中農(nóng)民參與主體的參與問(wèn)題,研究認(rèn)為新農(nóng)村建設(shè)中產(chǎn)生的公眾參與問(wèn)題主要有農(nóng)民主體文化素質(zhì)低參與意識(shí)淡薄、農(nóng)民經(jīng)濟(jì)合作社缺乏有效管理機(jī)制無(wú)法反應(yīng)參與訴求、政府對(duì)待農(nóng)民參與的重視程度尚待提高、法律上缺乏對(duì)農(nóng)村公眾參與的保障等。本文從參與主體的意識(shí)形態(tài)、新農(nóng)村建設(shè)的參與形式與途徑內(nèi)容等方面進(jìn)行思考,結(jié)合調(diào)研結(jié)果得出結(jié)論安徽省新農(nóng)村建設(shè)中公眾參與工作有待發(fā)展完善,解決新農(nóng)村建設(shè)中的公眾參與問(wèn)題需要農(nóng)民參與主體、政府保障、社會(huì)志愿者團(tuán)體的共同協(xié)作。
[Abstract]:An efficient and orderly public consultation is a concentrated embodiment of the sound or not democratic rule of law in the country. In the decision of the CPC Central Committee on comprehensively promoting the Rule of Law in an All-round way, it is pointed out that the important task of administering the country according to law includes strengthening the concept of the rule of law by the whole people. We will promote the construction of social rule of law. And respecting and safeguarding human rights is the basic principle of socialist rule of law. To promote public participation in the process of new rural construction can guarantee the basic democratic rights of citizens in the construction of new countryside, is an effective way to express farmers' demands, and can promote the process of democratic and legal work in the process of new rural construction. It embodies the important requirements of governing the country according to law. In the past, in the related research on promoting public participation, the focus is mainly on the overall national public participation, and there is a lack of research on promoting public participation in rural areas. The research on public participation is focused on the macroscopic consciousness and the system, the way, the lack of concrete problem analysis, for example, the previous research only regards the public participation as a participation activity and lacks the concrete division of the participants. The general conclusion is that the threshold of public participation in China is too high, the participation information is not perfect, the participation channel is missing and so on. On the basis of scientific investigation, this paper mainly adopts the method of questionnaire and interview to study the problem of public participation in the construction of new countryside in Anhui province and form a thesis. In the process of investigation and writing, combined with the research results of relevant scholars, on the basis of studying the general problems in the construction of new countryside, we focus on finding the problems of the main body of public participation in the construction of new countryside. And focus on the analysis of the participation of farmers in the construction of new rural areas, the study shows that the main problems of public participation in the construction of new rural areas are the low participation consciousness of farmers' main cultural quality. The lack of effective management mechanism of farmers' economic cooperatives can not reflect the demands of participation, the government should pay more attention to farmers' participation, and the law lacks the protection of rural public participation. This paper thinks about the ideology of the participants, the forms and ways of the new rural construction, and draws the conclusion that the public participation in the construction of the new countryside in Anhui Province needs to be developed and perfected. Solving the problem of public participation in the construction of new countryside requires the cooperation of farmers' participation main body, government guarantee and social volunteer group.
