【摘要】：考察英國(guó)光榮革命前國(guó)王的外交權(quán)力不僅有助于認(rèn)識(shí)專(zhuān)制時(shí)期王權(quán)的全貌,而且能夠回答史學(xué)界關(guān)于"光榮革命"與國(guó)王外交權(quán)變化關(guān)系的分歧。在都鐸時(shí)期,伊麗莎白一世開(kāi)"外交是君主特權(quán)"先河,禁止議會(huì)介入外交事務(wù)。該做法的依據(jù)在于外交是國(guó)家主權(quán)者的一項(xiàng)專(zhuān)屬權(quán)力并具有主權(quán)不受限制的特征。進(jìn)入斯圖亞特時(shí)期,這一特權(quán)開(kāi)始松動(dòng),議會(huì)以自身具有請(qǐng)?jiān)�、自由發(fā)言權(quán)為名要求參與外交事務(wù),還以批稅權(quán)干預(yù)國(guó)王戰(zhàn)爭(zhēng)政策。但由于國(guó)王不承認(rèn)議會(huì)的權(quán)利,因此外交大體上仍然是國(guó)王的特權(quán)。1688年前國(guó)王外交權(quán)力的歷史軌跡表明,國(guó)王外交權(quán)力將隨國(guó)家主權(quán)的變更,隨議會(huì)請(qǐng)?jiān)�、自由發(fā)言權(quán)的確認(rèn)而發(fā)生變化,這兩者在1688年光榮革命和1689年《權(quán)利法案》中得以實(shí)現(xiàn)。
[Abstract]:The study of the diplomatic power of the king before the glorious revolution of England is not only helpful to understand the whole picture of Wang Quan in the autocratic period, but also to answer the differences in the relationship between the "glorious revolution" and the change of the king's diplomatic power. During the Tudor period, Elizabeth I pioneered "diplomacy as the sovereign's prerogative", forbidding parliament from intervening in foreign affairs. This approach is based on the fact that diplomacy is an exclusive power of the sovereign and has an unrestricted character of sovereignty. In Stuart's time, this privilege began to loosen, with parliament demanding foreign affairs in the name of having a petition and free voice, and intervening in the king's war policy with tax powers. But because the king did not recognize the rights of Parliament, diplomacy remained largely the prerogative of the king. The historical course of the king's diplomatic power before 1688 showed that the king's diplomatic power would be petitioned by Parliament with the change of national sovereignty. The affirmation of freedom to speak changed, both in the glorious revolution of 1688 and in the Act of Rights of 1689.
