【摘要】：在繼承中國(guó)古代文官銓敘制度的基礎(chǔ)上,南京國(guó)民政府吸取西方文官銓敘制度的精華,創(chuàng)立了近代公務(wù)員銓敘制度。國(guó)民政府時(shí)期的公務(wù)員銓敘體系涵蓋了任用、考績(jī)、薪俸、退撫等內(nèi)容,規(guī)定了公務(wù)員相應(yīng)的權(quán)利及義務(wù)。通過(guò)銓敘法規(guī)的規(guī)定,任用資格、考績(jī)標(biāo)準(zhǔn)、薪俸水平、退撫待遇等涉及文官銓敘的具體內(nèi)容得以明確。南京國(guó)民政府從法律的制定、修改及實(shí)施上致力于公務(wù)員銓敘制度建設(shè),一定程度上起到了規(guī)范用人秩序、保障公務(wù)員權(quán)利等作用。可以說(shuō),公務(wù)員銓敘制度已經(jīng)初步具備近代性的特征,實(shí)現(xiàn)了傳統(tǒng)官吏制度向近代公務(wù)員制度的轉(zhuǎn)型,開(kāi)創(chuàng)了歷史的先河,具有重要的歷史意義。然而,由于黨治因素及人治因素,南京國(guó)民政府公務(wù)員銓敘制度在具體運(yùn)行上違背了現(xiàn)代文官制度的根本原則。加之囿于時(shí)代的限制,公務(wù)員銓敘制度運(yùn)行的收效甚微。國(guó)民政府用人腐敗的弊病難以根治,政權(quán)更加獨(dú)裁、腐敗,最終走向失敗。
[Abstract]:On the basis of inheriting the ancient Chinese civil service Quanxu system, the Nanjing National Government absorbed the quintessence of the western civil service Quanxu system and founded the modern civil servant Quanxu system. The Quanxu system of civil servants in the period of the National Government covered the contents of appointment, performance appraisal, salary, retirement and so on, and stipulated the corresponding rights and obligations of civil servants. Through the regulations of Quanxu, the qualification of appointment, the standard of performance, the level of salary, the treatment of retirement and so on, the specific contents of Quanxu are clarified. The Nanjing National Government devotes itself to the construction of Quanxu system of civil servants from the aspects of making, modifying and implementing the law, which to some extent plays a role in standardizing the order of employment and ensuring the rights of civil servants. It can be said that the Quanxu system of civil servants has already had the characteristics of modern times, has realized the transformation from the traditional official system to the modern civil servant system, has created the historical first, has the important historical significance. However, the Quanxu system of civil servants of Nanjing National Government violates the fundamental principle of modern civil service system in practice because of the factors of ruling by party and ruling by man. In addition, due to the limitations of the times, civil servants Quanxu system has little effect. The corruption of the national government is difficult to cure, the regime is more autocratic, corrupt, and finally fail.
