【摘要】：人的生活是一種社會(huì)性的生活,人的社會(huì)生活要得以可能,就必須是一種受到規(guī)范的生活,沒有規(guī)范就沒有社會(huì)的秩序,而一種無序的生活,即意味著是一種不可能的生活。人的社會(huì)生活存在著多個(gè)不同領(lǐng)域,有經(jīng)濟(jì)的、政治的、精神的區(qū)分。因而,社會(huì)規(guī)范也需要分成不同的類型,各種不同類型的社會(huì)規(guī)范對(duì)人們的社會(huì)生活起著不同的作用,不可將所有的社會(huì)規(guī)范簡(jiǎn)化為一。社會(huì)規(guī)范是人為社會(huì),也是人為自己的立法,而社會(huì)規(guī)范的立法基礎(chǔ)與根據(jù),是社會(huì)的生產(chǎn)方式與交換方式,它的功能既不是保障人們過一種幸福的生活,也不是保障人們過一種完美的生活,而只是保障人們過一種可能的生活。因而,評(píng)價(jià)一種社會(huì)規(guī)范合理與否、正當(dāng)與否的標(biāo)準(zhǔn)既不是是否能促進(jìn)人的幸福,也不是是否符合完美與神圣的要求,而在于是否符合社會(huì)的生產(chǎn)方式與交換方式的要求。社會(huì)的生產(chǎn)方式與交換方式是歷史的,因而社會(huì)規(guī)范也是歷史的,不存在永恒不變的,具有普世性的社會(huì)規(guī)范。
[Abstract]:Human's life is a kind of social life. To be possible, human's social life must be a kind of standard life, without norm, there is no social order, and a kind of disorderly life means an impossible life. There are many different fields of people's social life, there are economic, political and spiritual distinctions. Therefore, social norms also need to be divided into different types, different types of social norms play different roles in people's social life, we can not simplify all social norms into one. Social norms are not only artificial society, but also their own legislation, and the legislative basis of social norms is the mode of production and exchange of society, its function is neither to ensure that people live a happy life. Nor is it a guarantee of a perfect life, but of a possible life. Therefore, the criterion for evaluating whether a social norm is reasonable or not is not whether it can promote human happiness, nor whether it meets the requirements of perfection and sacredness, but whether it meets the requirements of the mode of production and exchange of society. The mode of production and exchange of society is historical, so social norms are historical, and there are no permanent and universal social norms.
