【摘要】：近年來(lái),國(guó)家越來(lái)越重視人民群眾在反腐敗斗爭(zhēng)中的重要作用,強(qiáng)調(diào)要緊緊依靠人民的支持,暢通群眾監(jiān)督渠道,發(fā)揮新媒體、新技術(shù)作用,形成無(wú)處不在的監(jiān)督網(wǎng),使群眾監(jiān)督無(wú)處不在。這就為行政監(jiān)督領(lǐng)域改革指明了方向:一是要重視、尊重并最大程度上發(fā)揮公眾的行政監(jiān)督主體作用,二是充分利用新技術(shù)的輔助力量,為監(jiān)督“插上科技的翅膀”。同時(shí),大數(shù)據(jù)迅速發(fā)展,激發(fā)出許多新思維、新技術(shù)和新方法,為解決當(dāng)前行政監(jiān)督的公眾參與機(jī)制內(nèi)容陳舊、效率不高以及實(shí)效不高等問(wèn)題提供了新的方法和出路。文章首先對(duì)當(dāng)前大數(shù)據(jù)和行政監(jiān)督公眾參與的相關(guān)研究和相關(guān)理論進(jìn)行了梳理和總結(jié),界定了大數(shù)據(jù)背景下行政監(jiān)督的公眾參與機(jī)制的內(nèi)涵,分析了該機(jī)制構(gòu)建的必要性。其次,通過(guò)網(wǎng)絡(luò)問(wèn)卷的形式,對(duì)各地公眾關(guān)于大數(shù)據(jù)背景下行政監(jiān)督參與的認(rèn)識(shí)、意愿及現(xiàn)實(shí)阻礙等問(wèn)題進(jìn)行了實(shí)證調(diào)查。同時(shí),選取并分析了國(guó)家紀(jì)委監(jiān)察部網(wǎng)站和秦皇島黨風(fēng)政風(fēng)監(jiān)督網(wǎng)兩個(gè)走在前列的公眾行政監(jiān)督參與平臺(tái),作為有益探索的案例。在此基礎(chǔ)上,得出了目前大數(shù)據(jù)背景下行政監(jiān)督的公眾參與機(jī)制的構(gòu)建具備了國(guó)家高度重視、大數(shù)據(jù)及移動(dòng)互聯(lián)網(wǎng)技術(shù)迅速發(fā)展以及公眾行政監(jiān)督參與積極性不斷提高等良好基礎(chǔ),但也面臨著公眾數(shù)據(jù)及監(jiān)督意識(shí)薄弱、頂層規(guī)劃缺失、技術(shù)應(yīng)用水平低、大數(shù)據(jù)專業(yè)人才匱乏以及數(shù)據(jù)安全隱患嚴(yán)重等現(xiàn)實(shí)挑戰(zhàn);最后,是大數(shù)據(jù)背景下行政監(jiān)督的公眾參與機(jī)制構(gòu)建的具體內(nèi)容,在結(jié)合先前的構(gòu)建現(xiàn)狀分析和最新的大數(shù)據(jù)與行政監(jiān)督公眾參與的理論知識(shí)基礎(chǔ)上,先明確了構(gòu)建符合時(shí)代要求和便捷安全有效公眾參與機(jī)制的構(gòu)建目標(biāo)及堅(jiān)持合法性與合理性、創(chuàng)新性與科學(xué)性、開(kāi)放性與安全性相統(tǒng)一的構(gòu)建原則,再進(jìn)一步從做好頂層設(shè)計(jì)、完善法律法規(guī)、提升數(shù)據(jù)意識(shí)、改進(jìn)參與平臺(tái)、拓展大數(shù)據(jù)技術(shù)、保障人財(cái)物支持、再造機(jī)制運(yùn)行和技術(shù)流程等方面分析機(jī)制的構(gòu)建路徑。
[Abstract]:In recent years, the state has paid more and more attention to the important role of the people in the fight against corruption. It emphasizes the importance of relying on the support of the people, unimpeding the supervision channels of the masses, giving full play to the new media and the role of new technology, and forming a ubiquitous supervision network to make the supervision of the masses everywhere. This has pointed out the direction for the reform of the administrative supervision field: one should pay attention to, Respecting and maximizing the role of the public's main body of administrative supervision, two is to make full use of the auxiliary power of the new technology and to supervise the "wings of science and technology". At the same time, the large data is rapidly developing, and many new ideas, new technologies and new methods have been stimulated, and the content of the public participation mechanism of the current administrative supervision is old and inefficient. It provides a new method and way out for the problem of low actual effect. First, the article reviews and summarizes the relevant research and related theories of public participation in the current big data and administrative supervision, defines the connotation of the public participation mechanism under the background of the big data and analyzes the necessity of the construction of the system. Secondly, through the network questionnaire In the form, this paper makes an empirical investigation on the public's awareness of the participation of administrative supervision under the large data background, the willingness and reality of the obstacles. At the same time, it selects and analyzes two public administrative supervisor participation platforms, which are in the forefront of the national discipline supervision department website and the Qinhuangdao party wind supervision network, as a useful exploration case. On the basis of this, it is concluded that the construction of public participation mechanism of administrative supervision under the background of large data has a good foundation for the high attention of the state, the rapid development of large data and mobile Internet technology and the increasing enthusiasm of public administration supervision, but it also faces the weakness of the public data and supervision consciousness, the lack of top-level planning, and the technology. In the end, it is the concrete content of the construction of the public participation mechanism of administrative supervision under the background of large data. On the basis of the previous analysis of the construction status and the theoretical knowledge of the most recent large data and the public participation of the administrative supervision, the construction of the public participation mechanism is first made clear. In accordance with the requirements of the times and convenient and safe and effective public participation mechanism, the establishment of the principle of unity of legitimacy and rationality, innovation and science, openness and security, and further development of the top-level design, the improvement of the laws and regulations, the improvement of the data awareness, the improvement of the participation platform, the expansion of the large data technology and the guarantee of the property of the human beings Support, reconstruction mechanism operation and technology flow analysis mechanism construction path.
