【摘要】：非法移民是一個(gè)國(guó)際現(xiàn)實(shí)問(wèn)題,又是一個(gè)極富爭(zhēng)議性的問(wèn)題。國(guó)際非法移民治理是一個(gè)長(zhǎng)期復(fù)雜的綜合性工程,面臨主權(quán)與人權(quán)的矛盾、法律原則與人道主義的矛盾、不同行為主體利益訴求之間的矛盾等諸多困境。正確認(rèn)知非法移民問(wèn)題的實(shí)質(zhì),科學(xué)判斷非法移民的動(dòng)因與性質(zhì),完善非法移民多層治理結(jié)構(gòu),充分發(fā)揮國(guó)家治理、區(qū)域治理與國(guó)際治理的互補(bǔ)性以實(shí)現(xiàn)全球均衡與可持續(xù)發(fā)展,是破解國(guó)際非法移民難題的必要途徑。只有著眼于長(zhǎng)遠(yuǎn)與根本,消除人類社會(huì)發(fā)展的不平衡現(xiàn)象,尤其是經(jīng)濟(jì)發(fā)展的失衡,加強(qiáng)國(guó)際體系的公正合理性,才能真正實(shí)現(xiàn)人的全面、自主、有尊嚴(yán)的發(fā)展。
[Abstract]:Illegal immigration is not only an international reality problem, but also a controversial issue.The management of international illegal immigrants is a long-term complex comprehensive project, which faces many difficulties, such as the contradiction between sovereignty and human rights, the contradiction between legal principles and humanitarianism, the contradiction between the interests of different actors and so on.Correctly recognizing the essence of the problem of illegal immigration, scientifically judging the motivation and nature of illegal immigrants, perfecting the multi-layer governance structure of illegal immigrants, and giving full play to national governance,The complementarity between regional governance and international governance to achieve global balance and sustainable development is a necessary way to solve the problem of international illegal migration.Only if we focus on the long-term and fundamental, eliminate the imbalance of human social development, especially the imbalance of economic development, and strengthen the justice and rationality of the international system, can we truly realize the all-round, autonomous and dignified development of human beings.
