【摘要】：相對(duì)完備的人大常委會(huì)委員任職規(guī)范是實(shí)現(xiàn)常委會(huì)委員依法履職的制度保障。當(dāng)前該類規(guī)范設(shè)定雖已初具規(guī)模,但碎片化明顯,有必要基于其實(shí)施規(guī)制的組織、保障、監(jiān)督這三個(gè)環(huán)節(jié),展開(kāi)全面性、完整性地規(guī)范分析。任職組織規(guī)范關(guān)涉人大組織機(jī)構(gòu)的內(nèi)部治理命題,是委員任職規(guī)范設(shè)定的終極目的,應(yīng)確立常態(tài)化履職規(guī)范、輔助機(jī)構(gòu)功能化規(guī)范以及聯(lián)系代表實(shí)效化規(guī)范。任職保障規(guī)范關(guān)涉常委會(huì)委員的履職激勵(lì)命題,是委員任職規(guī)范設(shè)定的基本手段,應(yīng)確立履職物質(zhì)條件充分化規(guī)范和履職培訓(xùn)績(jī)效化規(guī)范。任職監(jiān)督規(guī)范關(guān)涉常委會(huì)委員的履職監(jiān)察命題,是委員任職規(guī)范設(shè)定的根本保障,應(yīng)確立履職標(biāo)準(zhǔn)清晰化規(guī)范、履職信息公開(kāi)規(guī)程化規(guī)范以及履職考核復(fù)合化規(guī)范。
[Abstract]:The relatively complete standard of the NPC standing Committee is the system guarantee for the standing Committee members to carry out their duties in accordance with the law.Although the establishment of this kind of norms has begun to take shape at present, the fragmentation is obvious. It is necessary to conduct a comprehensive and complete normative analysis based on the organization, protection and supervision of the regulations.It is the ultimate purpose of the setting of the standing norms of the members to regulate the internal governance of the people's Congress organizations. It is necessary to establish the norms of the regular performance of duties, the functional norms of the auxiliary organizations and the norms of the effectiveness of the association representatives.The norm of post security concerns the proposition of the standing committee members' performance incentive, which is the basic means of setting the standard of the member's post. It is necessary to establish the sufficient standard of material condition of carrying out duties and the criterion of performance of duty training.It is the fundamental guarantee for the establishment of the standing committee members' performance supervision to regulate the performance supervision. It is necessary to establish the clear standard of performing duties, the standard of publicity of information and the compound norm of performance assessment.
