【摘要】："因俗而治"是明清統(tǒng)治者根據(jù)土司地區(qū)少數(shù)民族實際情況制定的民族政策。明清中央政府的"因俗而治"主要體現(xiàn)在三個方面:一是在行政體制方面,實施"多軌制";二是在管理制度方面,體現(xiàn)"差異化";三是在司法制度方面,注重"變通性"。地方土司政權的"因俗而治"主要是通過政治制度、經濟制度以及司法制度得以實施。明清中央政府實施"因俗而治"的前提是必須維護中央王朝的統(tǒng)治,凡無礙于中原王朝統(tǒng)治的風俗習慣可"因俗",而有礙于中原王朝統(tǒng)治的各種制度則不能"因俗"。"因俗而治"政策的實施效果極其顯著:既推動了邊疆土司地區(qū)的內地化,又推動了國家法制建設的漸進化。明清時期的"因俗而治"政策是適合土司地區(qū)少數(shù)民族社會生活實際的一種行之有效的民族政策。
[Abstract]:"Because of customs and rule" is the rulers of the Ming and Qing Dynasties according to the practical situation of minority area Tusi set national policy. The central government "rule by custom" is mainly embodied in three aspects: one is in the administrative system, the implementation of the "multi track system"; the two is in the management system, embodies the "difference".; three is the judicial system, pay attention to the "adaptation". Local Tusi regime for custom and rule is mainly through the political system, economic system and the judicial system is implemented. The implementation of central government "rule by custom" prerequisite is to maintain the central dynasty's rule, which does no harm to the Central Plains rule of customs can be "vulgar", and various systems in the Central Plains Dynasty which are not "vulgar". "The implementation effect because of customs and rule" policy is significant: both promote the frontier regions of the mainland toast, and promote the gradual construction of the national legal system in Ming and Qing Dynasties. The policy of "the rule of vulgarity" in the period is an effective national policy suitable for the reality of the social life of the minority nationalities in Tusi.
