【摘要】：中國古代官吏懲戒制度在具體實施過程中成效顯著,在規(guī)范行政、懲處違法、褒獎功臣方面,對保證官僚組織有序運轉(zhuǎn)發(fā)揮了積極作用。在專制主義中央集權(quán)體制內(nèi)構(gòu)建的懲戒制度,其局限性也是難免的,所存在難以克服的弊端更會影響其效能的發(fā)揮。懲戒制度作為一個官僚大系統(tǒng)中的小系統(tǒng),不可能脫離君主專制主義中央集權(quán)體制,更難改變當時的政治環(huán)境,其成效的大小,往往與君主之意志、黨爭之消長以及時局穩(wěn)定與否有直接的關(guān)系,也影響到具體的實施。古代官吏懲戒制度雖然不可能適用于現(xiàn)代,但在某些方面可以提供有益的啟示:其合理性與弊端,可為現(xiàn)代公務(wù)員懲戒制度的構(gòu)建提供經(jīng)驗和教訓(xùn);其分類有借鑒和參考價值;公罪與私罪原則,以及行政責(zé)任與刑事責(zé)任的承擔(dān),伴以經(jīng)濟上的處罰,對現(xiàn)代公務(wù)員懲戒制度的構(gòu)建也有啟示;官吏懲戒的議定程序,對構(gòu)建現(xiàn)代公務(wù)員懲戒權(quán)力集中問題也有啟示。君主專制中央集權(quán)制的國家,君主易于受到蒙蔽,而君主自身的局限,使他們在駕馭官僚方面存在難以想象的困難。
[Abstract]:In ancient China, the disciplinary system of government officials achieved remarkable results in the specific implementation process. In terms of standardizing administration, punishing violations of the law, and honoring meritorious officials, It has played a positive role in ensuring the orderly operation of bureaucratic organizations. The limitations of the disciplinary system built within the centralized system of autocracy are also unavoidable. As a small system in a large bureaucratic system, it is impossible to break away from the centralized system of monarchy, and it is even more difficult to change the political environment at that time and the extent of its effectiveness. It is often directly related to the will of the monarch, the rise and fall of the party dispute, and whether the situation is stable or not, and it also affects the concrete implementation. Although the ancient system of disciplinary punishment for officials cannot be applied to modern times, But it can provide some useful enlightenment in some aspects: its rationality and malpractice can provide experience and lessons for the construction of modern civil servant disciplinary system, its classification has reference and reference value, the principle of public crime and private crime, The assumption of administrative responsibility and criminal responsibility, accompanied by economic punishment, also has implications for the construction of modern civil servant disciplinary system. The monarch is apt to be deceived, and the monarch's own limitation makes them have unimaginable difficulties in managing the bureaucracy.
