【摘要】：參議會(huì)制度是南京國民政府實(shí)施地方自治的一次重要嘗試,在中華民國的地方自治制度建設(shè)中具有重要的地位,但是這一制度的建設(shè)也經(jīng)歷了不少的波折。在本文中將主要研究抗日戰(zhàn)爭后的昆明市參議會(huì),在大量文獻(xiàn)資料的研究基礎(chǔ)上,對(duì)1945年至1949年之間的昆明市參議會(huì)的組織沿革、組織機(jī)構(gòu)建設(shè)、職權(quán)的行使和特點(diǎn)意義進(jìn)行研究,以期獲得昆明市參議會(huì)在當(dāng)時(shí)社會(huì)環(huán)境下為云南地方自治、憲政民主推進(jìn)、社會(huì)現(xiàn)代化進(jìn)程起到何種影響。 全文分為六個(gè)部分,分別論述昆明市參議會(huì)的籌組建設(shè),回顧了參議會(huì)制度在中國實(shí)施的源流和沿革；昆明市參議會(huì)對(duì)市政府及相關(guān)部門工作報(bào)告的聽取與質(zhì)詢情況,并對(duì)案例進(jìn)行了比較深入的分析；昆明市參議會(huì)建議權(quán)的使用和決議案的執(zhí)行,以及市參議會(huì)派員參加市政會(huì)議時(shí)提出建議的概況；昆明市參議會(huì)受理民間請(qǐng)?jiān)赴傅那闆r,并分析了有關(guān)典型案例；概括了昆明市參議會(huì)體現(xiàn)出的特點(diǎn)和具有的歷史意義；本文對(duì)昆明市參議會(huì)進(jìn)行的研究而做的結(jié)語,對(duì)民國時(shí)期推行的參議會(huì)制度進(jìn)行綜合論述評(píng)價(jià)。 本文認(rèn)為昆明市參議會(huì)是昆明市的民意咨詢機(jī)關(guān),建立在處于半獨(dú)立狀態(tài)的云南省,因而不可避免打上當(dāng)時(shí)政治社會(huì)環(huán)境的烙印,與這一歷史情況相聯(lián)系而體現(xiàn)出自己的特點(diǎn),比如職權(quán)的擴(kuò)張性和地方政治色彩。參議會(huì)制度的實(shí)施對(duì)中國和昆明市地方自治的發(fā)展都有不可或缺的影響,對(duì)于中國民主政治的發(fā)展有積極意義,雖然這一制度也存在許多不足,但是經(jīng)驗(yàn)和教訓(xùn)仍然值得借鑒。
[Abstract]:The Senate system is an important attempt of the Nanjing National Government to implement local autonomy, and plays an important role in the construction of the local autonomy system of the Republic of China. However, the construction of this system has gone through a lot of twists and turns. In this paper, we will mainly study the Kunming City Council after the War of Resistance against Japan. On the basis of a great deal of literature, the organization and evolution of the Kunming Senate between 1945 and 1949 will be studied. This paper studies the construction of organization, the exercise of functions and powers and the significance of its characteristics in order to obtain the influence of Kunming Council on Yunnan's local autonomy, constitutional democracy and the process of social modernization under the social environment at that time. The full text is divided into six parts, respectively discussing the preparatory construction of Kunming Municipal Council, reviewing the origin and evolution of the implementation of the Senate system in China, hearing and questioning the work reports of the municipal government and relevant departments, The case is analyzed in depth; the use of the right of proposal and the implementation of the resolution of Kunming City Senate; and the general situation of the city council sending members to attend the municipal meeting to put forward suggestions; the Kunming City Council accepts the case of folk petition. It also analyzes some typical cases, summarizes the characteristics and historical significance of Kunming Council, and makes a comprehensive discussion and evaluation of the Senate system during the period of the Republic of China. This paper holds that Kunming City Council is the public opinion advisory organ of Kunming City, which is established in Yunnan Province, which is in a semi-independent state, and is inevitably branded by the political and social environment at that time. Linked to this historical situation, it reflects its own characteristics, such as the expansibility of its functions and powers and the local political color. The implementation of the Senate system has an indispensable impact on the development of local autonomy in both China and Kunming. It has positive significance for the development of Chinese democratic politics, although there are many deficiencies in this system, but the experience and lessons are still worth learning.
