【摘要】：通過對于明清兩代中琉兩國交往情況的梳理與回顧,可以比較直觀地看到東亞地區(qū)不同于西方模式的傳統(tǒng)國際法秩序的體系是如何長期維持并有效運作的,以及這一模式的維持與運作背后的巨大經(jīng)濟利益與國家安全動因。而日本入侵導致琉球的覆亡,作為東亞地區(qū)新舊國際法秩序嬗變的重要節(jié)點,宣示了傳統(tǒng)的中國中心的封貢體系的國際法秩序終于開始崩潰;中華文化圈內(nèi)的各國在歷史的因緣際會中終于被裹挾進入了西方近代殖民主義的國際法新秩序當中。在這個過程中,可以看到日本是如何積極融入,并充分運用這一新的國際法秩序,實現(xiàn)其稱霸東亞的野心;而中國又是如何因應這種變局,由顢頇懵懂的錯愕到被迫無奈的適應的轉變。回顧東亞地區(qū)新舊國際法秩序的嬗變歷程,對于解決目前國際關系的一些紛擾,改良甚至是重構一個更為合理的國際法秩序具有重要的史鑒意義。
[Abstract]:Through combing and reviewing the exchanges between China and Ryukyu in the Ming and Qing dynasties, we can see more intuitively how the system of the traditional international law order in East Asia, different from the western model, has been maintained and operated effectively for a long time. And the huge economic interests and national security motives behind the maintenance and operation of this model, and the Japanese invasion led to the collapse of Ryukyu, as an important node of the evolution of the old and new international law order in East Asia. The international law order, which declared the traditional centerpiece system in China, finally began to collapse. The countries in the Chinese cultural circle were finally coerced into the new international law order of modern colonialism in the West in the context of historical interrelationship. In this process, we can see how Japan has been actively integrated. And make full use of this new international law order to realize its ambition of dominating East Asia; And how does China respond to this change, from a consternation of stupidity to a change of forced adaptation. Looking back at the evolution of the old and new international law order in East Asia, it is necessary to solve some of the current troubles in international relations. Improving or even reconstructing a more reasonable international law order has important historical significance.
