【摘要】：人大專題詢問(wèn)是一種新的監(jiān)督方式。2010年6月24日,十一屆全國(guó)人大常委會(huì)第十五次會(huì)議分組審議國(guó)務(wù)院關(guān)于2009年中央決算報(bào)告時(shí)首次開(kāi)展了專題詢問(wèn)。此后,全國(guó)人大常委會(huì)多次運(yùn)用專題詢問(wèn)的方式進(jìn)行監(jiān)督。內(nèi)容涉及百姓衣食住行各方面的重大民生問(wèn)題。地方各級(jí)人大常委會(huì)受到啟發(fā),相繼效仿采用專題詢問(wèn)這一監(jiān)督方式,促進(jìn)了各地一些民生問(wèn)題的解決。寧波市各級(jí)人大也正嘗試著開(kāi)展這項(xiàng)工作。本文從寧波市各級(jí)人大專題詢問(wèn)開(kāi)展情況入手,分析專題詢問(wèn)獲得的經(jīng)驗(yàn),找出在此過(guò)程中出現(xiàn)的問(wèn)題,思考補(bǔ)充專題詢問(wèn)相關(guān)理論的薄弱環(huán)節(jié),并提出相應(yīng)對(duì)策建議。本文第一部分分別闡述詢問(wèn)、質(zhì)詢、專題詢問(wèn)的概念,比較專題詢問(wèn)與詢問(wèn)、質(zhì)詢存在的區(qū)別,簡(jiǎn)要說(shuō)明專題詢問(wèn)的功能,分析專題詢問(wèn)的理論基礎(chǔ)。本文第二部分介紹寧波市各級(jí)人大使用專題詢問(wèn)開(kāi)展監(jiān)督工作的實(shí)踐情況。說(shuō)明寧波各地人大開(kāi)展專題詢問(wèn)的總體情況,并以寧波市人大常委會(huì)、鎮(zhèn)海區(qū)人大常委會(huì)開(kāi)展專題詢問(wèn)會(huì)的詳細(xì)情況為例,總結(jié)收獲的相關(guān)經(jīng)驗(yàn)。本文第三部分指出寧波市各級(jí)人大在開(kāi)展專題詢問(wèn)過(guò)程中存在的問(wèn)題以及原因。指出存在法律法規(guī)保障欠缺、專題詢問(wèn)非常態(tài)化、運(yùn)行機(jī)制尚待健全、人大自身建設(shè)不足、公開(kāi)程度不夠等五方面的問(wèn)題。并從依法監(jiān)督意識(shí)不強(qiáng)、人大自身組織機(jī)構(gòu)障礙、履職能力不足、實(shí)踐經(jīng)驗(yàn)不夠等四個(gè)方面來(lái)分析造成問(wèn)題的原因。本文第四部分提出完善寧波市各級(jí)人大專題詢問(wèn)的詳細(xì)對(duì)策。找出完善法律法規(guī)建設(shè)、鼓勵(lì)專題詢問(wèn)朝常態(tài)化發(fā)展、進(jìn)一步完善其運(yùn)行機(jī)制、做好人大自身建設(shè)和提高公開(kāi)化程度等五個(gè)方面的解決對(duì)策。
[Abstract]:Special question of NPC is a new way of supervision. June 24th 2010. The 15th session of the standing Committee of the Eleventh National people's Congress (NPC) conducted a special inquiry for the first time during its deliberations on the report of the State Council on the final accounts of the Central Committee for 2009. The standing Committee of the National people's Congress has repeatedly used the method of special inquiry to carry out supervision. The contents concern the people's livelihood issues in all aspects of clothing, food, housing and transportation, and the local people's congresses at all levels have been inspired. Following the example of thematic inquiry, this monitoring method has been adopted one after another. Ningbo people's Congress at all levels is also trying to carry out this work. This article from the Ningbo people's Congress at all levels to begin with the development of thematic inquiries, analysis of the experience gained from thematic inquiries. Find out the problems that appear in this process, think about the weak link of supplementary topic inquiry related theory, and put forward the corresponding countermeasures. The first part of this article respectively elaborates the concept of inquiry, inquiry and thematic inquiry. Compare the differences between the special inquiry and the inquiry, and briefly explain the function of the thematic inquiry. The second part of this article introduces the practice of Ningbo people's Congress at all levels to carry out the supervision work, and explains the overall situation of Ningbo people's Congress to carry out the special inquiry. And take Ningbo City people's Congress standing Committee, Zhenhai District people's Congress standing Committee to carry out the special topic inquiry meeting detailed situation as an example. Summary of harvest experience. The third part of this paper points out the problems and reasons of Ningbo people's Congress at all levels in the process of conducting thematic inquiries. The operating mechanism is still to be perfected, the construction of the NPC itself is insufficient, the degree of publicity is not enough and so on, and the consciousness of supervision according to law is not strong, the organizational structure of the NPC itself is obstructed, and the ability to perform its duties is insufficient. The 4th part of this paper puts forward the detailed countermeasures to perfect the special inquiry of Ningbo people's Congress at all levels, and finds out the perfect construction of laws and regulations. We should encourage the topic inquiry to develop in a normal way, further improve its operating mechanism, do a good job in the construction of the National people's Congress itself and raise the degree of openness.
