【摘要】：現(xiàn)代社會中,政府基于其危險防止型行政的角色定位,需要在特定情形下對自然災(zāi)害所造成的損害承擔(dān)賠償責(zé)任。就危險防止型行政中的行政不作為是否違法,主要存在預(yù)見可能性、結(jié)果避免可能性、期待可能性和受損法益的重大性這四項判斷要件。其中,能否預(yù)見到自然災(zāi)害的發(fā)生至關(guān)重要。為此,需要從國家責(zé)任的視角出發(fā),對政府在應(yīng)對自然災(zāi)害中預(yù)見可能性的概念、判斷標(biāo)準(zhǔn)、判斷要素等進行分析,闡述政府對自然災(zāi)害具有預(yù)見可能性的條件,并進而應(yīng)為其不履行職責(zé)的行為承擔(dān)法律責(zé)任。具體而言,在國家法律責(zé)任層面上,政府在應(yīng)對自然災(zāi)害中的預(yù)見可能性應(yīng)以通常狀態(tài)或者一般注意義務(wù)為前提,以蓋然性為標(biāo)準(zhǔn),并因個案不同存有差異。借由對日本預(yù)見可能性概念進行的梳理,可以在我國國家賠償制度中引入預(yù)見可能性理念及危險防止型行政責(zé)任體系,進而對我國國家責(zé)任體系進行反思。
[Abstract]:In modern society, the government, based on its role in hazardous and preventive administration, needs to assume liability for damages caused by natural disasters under certain circumstances. There are mainly four elements of judgment, namely, the possibility of foresee, the possibility of avoiding the result, the possibility of expectation and the importance of the injured legal interest. Among them, it is very important to foresee the occurrence of natural disaster. From the point of view of national responsibility, this paper analyzes the concept, criteria and elements of the government's anticipatory possibility in dealing with natural disasters, and expounds the conditions under which the government has the possibility to foresee natural disasters. And then it should bear legal responsibility for its failure to perform its duties. Specifically, on the level of national legal responsibility. In dealing with natural disasters, the government should take the normal state or the general duty of care as the premise, and take the probability as the standard. By combing the concept of the possibility of foresight in Japan, we can introduce the concept of foreseeable possibility and the system of administrative liability of risk prevention in the national compensation system of our country. Then we reflect on our national responsibility system.
