【摘要】：解禁集體自衛(wèi)權(quán)在憲法層面上涉及的是憲法規(guī)范的變動(dòng)問題,安倍政權(quán)推進(jìn)解禁集體自衛(wèi)權(quán)是典型的憲法規(guī)范的不正常變動(dòng),其本質(zhì)是對(duì)憲法的破壞和侵害,屬于違憲行為。本文從禁止集體自衛(wèi)權(quán)的法的內(nèi)涵入手,闡釋禁止集體自衛(wèi)權(quán)的淵源、主體和內(nèi)容,以及日本解禁集體自衛(wèi)權(quán)的進(jìn)程。在此基礎(chǔ)上,從憲法修改的前提條件、憲法修改的實(shí)質(zhì)性限制、憲法修改的程序性規(guī)定、內(nèi)閣的憲法解釋權(quán)限,以及《日本國(guó)憲法》與《波茲坦公告》和《開羅宣言》之間的法律位階關(guān)系等方面,對(duì)日本解禁集體自衛(wèi)權(quán)的違憲問題進(jìn)行法理分析。
[Abstract]:Lifting the prohibition of collective self-defense in the constitutional level is involved in the change of constitutional norms, the Abe regime to promote the lifting of collective self-defence is a typical abnormal changes of constitutional norms, its essence is the destruction and infringement of the Constitution. This article begins with the connotation of the law prohibiting collective self-defence, explains the origin, subject and content of the right to prohibit collective self-defence, and the process of lifting the right of collective self-defence in Japan. From the precondition of the constitutional amendment, the substantive limitation of the constitutional amendment, the procedural provisions of the constitutional amendment, the power of the cabinet to interpret the constitution. And the legal rank relationship between the Constitution of Japan and the Proclamation of Poztan and the Cairo Declaration, etc., this paper makes a legal analysis on the unconstitutional issue of the right of collective self-defense to be lifted in Japan.
