【摘要】：在兒童非治療性醫(yī)學(xué)試驗(yàn)中,充斥著知情同意不完全。尊重兒童作為潛在人類尊嚴(yán)的道德律令要求允許兒童參與試驗(yàn)的同意決定。與此同時(shí),由于兒童自身不具備完全行事能力,基于"最佳利益"將代理權(quán)讓渡其父母或監(jiān)護(hù)人。而為了確保代理同意和試驗(yàn)的公正性與合理性,需倫理機(jī)構(gòu)介入審核,以起到維護(hù)"公共健康"的作用。由此構(gòu)造出"知情同意"的條件及其判定的"兒童-代理人-倫理審查機(jī)構(gòu)"的權(quán)力三角關(guān)系。
[Abstract]:In children's non-therapeutic medical trials, informed consent is rife with incomplete consent. A code of ethics that respects children as potential human dignity requires consent decisions that allow children to participate in the experiment. At the same time, as the child is not fully capable of acting himself, the agency is ceded to his parents or guardians in the "best interest". In order to ensure the fairness and reasonableness of agency consent and experiment, ethical institutions should intervene in the audit to safeguard public health. This paper constructs the condition of informed consent and the power triangle relation of "child-agent-ethics review body".
