【摘要】：黨內(nèi)法規(guī)體系建設是規(guī)范黨內(nèi)權(quán)力制度化、規(guī)范化的根本舉措,關乎國家治理體系和治理能力的現(xiàn)代化。黨內(nèi)法規(guī)存在著內(nèi)容龐雜、體系分散、板塊不全等問題,同時,黨內(nèi)法規(guī)與國家法律之間存在高度契合點,在國家治理方面可以實現(xiàn)良好的相互補充。因此,需要從法學視角去探尋黨的建設中的法治規(guī)律,即以憲法思維作為總體指導思想,在制度設計中保持與其他法律規(guī)范內(nèi)容上的協(xié)調(diào)和黨內(nèi)法規(guī)內(nèi)部的協(xié)調(diào),確保體系的完備和執(zhí)行力,以權(quán)利義務為內(nèi)容,兼顧黨內(nèi)法規(guī)的一般性和特殊性、制定程序上的科學性,用備案等制度完善法規(guī)制定程序,尋找黨內(nèi)法律與國家法律的契合之處,加強黨內(nèi)法規(guī)的硬性約束力。
[Abstract]:The construction of inner-party laws and regulations system is the fundamental measure to standardize the inner-party power institutionalization and standardization, which is related to the modernization of the national governance system and governance ability. There are many problems in inner-party laws and regulations, such as heavy contents, scattered systems, incomplete plates, and so on. At the same time, there is a high degree of agreement between inner-party laws and national laws, which can complement each other well in the aspect of national governance. Therefore, it is necessary to explore the rule of law in the construction of the Party from the perspective of law, that is, to take the constitutional thinking as the overall guiding ideology, to maintain the coordination with the contents of other laws and regulations and the internal coordination of the laws and regulations within the Party in the design of the system. To ensure the completeness and execution of the system, to take the rights and obligations as the content, to take into account the generality and particularity of the laws and regulations within the Party, to formulate the scientific nature of the procedures, and to perfect the procedures for the formulation of laws and regulations by means of systems such as Find out the conformity of inner-party law and national law, and strengthen the rigid binding force of inner-party law.
