【摘要】：依法治國是中國發(fā)展的必然選擇。中國共產(chǎn)黨在依法治國中居于領(lǐng)導(dǎo)地位,黨的領(lǐng)導(dǎo)是全面推進(jìn)依法治國、加快建設(shè)社會(huì)主義法治國家最根本的保證。必須加強(qiáng)和改進(jìn)黨對(duì)法治工作的領(lǐng)導(dǎo),把黨的領(lǐng)導(dǎo)貫徹到全面推進(jìn)依法治國全過程。在我國,依規(guī)治黨不僅具有理論上的必要性,更具有現(xiàn)實(shí)的緊迫性。就依規(guī)治黨與依法治國之間的關(guān)系來說,依法治國與依規(guī)治黨是相互影響,相互制約的。立足于法治的角度上,依規(guī)治黨的目的是要使廣大黨員干部形成對(duì)作為規(guī)則的黨內(nèi)法規(guī)之敬畏與尊重,使其能夠切實(shí)在管黨治黨方面發(fā)揮作用。然而,就目前來看,依規(guī)治黨無論在依規(guī)治黨之"規(guī)"方面,還是在依規(guī)治黨之"治"方面,都還顯然存在不少亟須改進(jìn)和完善的問題。為此,需要繼續(xù)強(qiáng)化依規(guī)治黨之"規(guī)"方面的建設(shè),重視黨內(nèi)法規(guī)"立規(guī)"的合法性與程序性,加強(qiáng)黨內(nèi)法規(guī)之"規(guī)"在內(nèi)容上的規(guī)范性與可操作性,推進(jìn)黨內(nèi)法規(guī)制度體系建設(shè);需要改進(jìn)依規(guī)治黨之"治"方面的建設(shè),提高黨內(nèi)法規(guī)的執(zhí)行力,并減少和避免黨內(nèi)法規(guī)與國家法的沖突與不協(xié)調(diào)。
[Abstract]:The rule of law is the inevitable choice of the development of Chinese. China Communist Party playing the leading role in the rule of law, the leadership of the party is to promote the rule of law, accelerate the construction of a socialist country under the rule of the most fundamental guarantee. We must strengthen and improve the Party leadership in the rule of law, and the party's leadership to implement comprehensively promote the rule of law in my whole process. In accordance with regulations, the party is not only the necessity in theory, has the reality urgency. The relationship between the party and the rule of law and regulations, the rule of law in accordance with regulations and the party are mutual influence and mutual restriction. Based on the perspective of the rule of law in accordance with regulations, the party's purpose is to make the masses of cadres party on the formation rules of regulations of the party as awe and respect, so that it can effectively play a role in the management and Administration of the party.
